- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Writ: A formal written command, issued from the court, requiring the performance of a specific act.
The service shall be made by leaving the original writ with the defendant, and preserving a copy thereof on which to make the return of service, but a failure in this respect shall not be held material.
