Terms Used In Kansas Statutes 16-1906

  • Contractor: means a person performing construction and having a contract with an owner of the real property or with a trustee or agent of an owner. See Kansas Statutes 16-1902
  • Property: includes personal and real property. See Kansas Statutes 77-201
  • Venue: The geographical location in which a case is tried.

In any action to enforce Kan. Stat. Ann. § 16-1903, 16-1904 or 16-1905, and amendments thereto, including arbitration, between a contractor and subcontractors or subcontractors and subcontractors, the court or arbitrator shall award costs and reasonable attorney fees to the prevailing party. Venue of such an action shall be in the county where the real property is located and under Kansas law. The hearing in such an arbitration shall be held in the county where the real property is located.
