Terms Used In Kansas Statutes 65-1437

(a) A person licensed to practice dentistry by the Kansas dental board shall not on such licensee’s own behalf, a licensee’s partner, associate or any other licensee affiliated with the licensee or the licensee’s practice, use or participate in the use of any form of advertising which:

(1) Contains false, fraudulent, misleading or deceptive statements or claims;

(2) represents that the licensee is specially qualified in or limits the practice of the licensee to a branch of dentistry which is a specialty recognized by the Kansas dental board unless the licensee holds a special certificate of qualification within such specialty authorized under Kan. Stat. Ann. §§ 65-1427 and amendments thereto; or

(3) contains statements regarding the professional superiority or the performance of professional services in a superior manner by the licensee or group of licensees, unless each statement can be factually substantiated.

(b) The board may adopt rules and regulations for the administration of this section and may provide as part of such rules and regulations guidelines and examples of conduct allowed and prohibited under this section.

(c) The term “licensee” as used in this section means a person licensed to practice dentistry in this state by the Kansas dental board.
