Terms Used In Kansas Statutes 76-12b04

  • Conservator: means an individual or corporation appointed by the court to act on behalf of a conservatee and possessed of some or all of the powers and duties set out in Kan. See Kansas Statutes 77-201
  • Guardian: means an individual or a nonprofit corporation certified in accordance with Kan. See Kansas Statutes 77-201
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Institution: means a state institution for people with intellectual disability including the following institutions: Kansas neurological institute and Parsons state hospital. See Kansas Statutes 76-12b01
  • Superintendent: means the chief administrative officer of the institution or the designee of the chief administrative officer. See Kansas Statutes 76-12b01

If in the opinion of the superintendent an applicant for admission meets the definition of a person in need of a guardian or a conservator, or both, as provided in Kan. Stat. Ann. §§ 59-3050 through 59-3095, and amendments thereto, the person shall not be admitted to an institution except for the purposes of conducting a court ordered evaluation pursuant to Kan. Stat. Ann. § 59-3064, and amendments thereto, until a court has determined the legal status of the person under the act for obtaining a guardian or conservator, or both. The provisions of this paragraph shall not be applicable if a court has already determined the legal status of the applicant under the act.
