Terms Used In Kansas Statutes 76-12b05

  • Guardian: means an individual or a nonprofit corporation certified in accordance with Kan. See Kansas Statutes 77-201
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Superintendent: means the chief administrative officer of the institution or the designee of the chief administrative officer. See Kansas Statutes 76-12b01

The superintendent shall periodically review a person’s status to insure that the criteria set forth in Kan. Stat. Ann. § 76-12b03 is still being met. A review shall be conducted at the end of 90 days, 180 days and one year from the date of admission and at least annually thereafter. A copy of the review report shall be furnished to the person, a natural guardian or a guardian and the court having jurisdiction of the guardianship.
