Where the injury, death, or destruction of fish or other wildlife results from pollution as defined in KRS § 224.1-010 or from any violation of the orders, rules, regulations, or other determinations of the cabinet, the person responsible therefor shall be liable to the Commonwealth in an amount reasonably necessary to restock or replenish such fish or wildlife. The Commonwealth shall, in addition to the penalties provided for in KRS
224.99-010, be empowered to seek the recovery of such damages in any court of competent jurisdiction in this Commonwealth in the event the person responsible fails or refuses to pay for the restocking or replenishing of such fish or wildlife in the water or area affected.

Terms Used In Kentucky Statutes 224.1-070

  • area: means any geographical area established or designated by the cabinet in accordance with the provisions of this chapter. See Kentucky Statutes 224.1-010
  • Cabinet: means the Energy and Environment Cabinet. See Kentucky Statutes 224.1-010
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
