  • abortion: means an act, procedure, device, or prescription administered or prescribed for a pregnant woman by any person, including the pregnant woman herself, producing premature expulsion of the fetus. See Kentucky Statutes 205.010
  • Abortion: means the purposeful interruption of pregnancy with the intention other than to produce a live-born infant or to remove a dead fetus and which does not result in a live birth. See Kentucky Statutes 213.011
  • Abuse: means the infliction of injury, sexual abuse, unreasonable confinement, intimidation, or punishment that results in physical pain or injury, including mental injury. See Kentucky Statutes 209.020
  • Activation date: means :
    (a) For all projects except those described in paragraph (b) of this subsection, the date established any time within a two (2) year period after the commencement date. See Kentucky Statutes 154.30-010
  • Active ingredient: means any ingredient which will prevent, destroy, repel, control, or mitigate pests, or which will act as a plant regulator, defoliant, or desiccant, or as a functioning agent in a spray adjuvant. See Kentucky Statutes 217.544
  • Adapted vehicle: means a new or used motor vehicle especially designed or modified for use by an aging or disabled person. See Kentucky Statutes 190.010
  • Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
  • Administer: means the direct application of a controlled substance, whether by injection, inhalation, ingestion, or any other means, to the body of a patient or research subject by:
    (a) A practitioner or by his or her authorized agent under his or her immediate supervision and pursuant to his or her order. See Kentucky Statutes 218A.010
  • Administrator: means the person or the designee of the person, in charge of the operation of substance use disorder prevention, intervention, or treatment program. See Kentucky Statutes 222.005
  • Adoption worker: means an employee of the cabinet so designated by the secretary for health and family services, a social worker employed by a county or city who has been approved by the cabinet to handle, under its supervision, adoption placement services to children, or a social worker employed by or under contract to a child-placing adoption agency. See Kentucky Statutes 199.011
  • Adult: means a person eighteen (18) years of age or older who, because of mental or physical dysfunctioning, is unable to manage his or her own resources, carry out the activity of daily living, or protect himself or herself from neglect, exploitation, or a hazardous or abusive situation without assistance from others, and who may be in need of protective services. See Kentucky Statutes 209.020
  • Adult adopted person: means any adopted person who is twenty-one (21)
    years of age or older. See Kentucky Statutes 199.011
  • Advance deposit account wagering: means a form of pari-mutuel wagering in which an individual may establish an account with a person or entity licensed by the racing commission, and may place a pari-mutuel wager through that account that is permitted by law. See Kentucky Statutes 230.210
  • Advertise: means the use of handbills, placards, posters, billboards, pictures, printed or written material or newspapers or other publications, or radio, television, Internet, and other communication media. See Kentucky Statutes 229.011
  • Advertising: means the giving of notice by publication pursuant to KRS Chapter
    424. See Kentucky Statutes 180.010
  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • Agency: means :
    (a) An urban renewal and community development agency established under
    KRS Chapter 99. See Kentucky Statutes 154.30-010
  • Agency: means a legal entity operating hospital-based or nonhospital-based substance use disorder prevention, intervention, or treatment programs. See Kentucky Statutes 222.005
  • Alcohol concentration: means either grams of alcohol per 100 milliliters of blood or grams of alcohol per 210 liters of breath. See Kentucky Statutes 189A.005
  • All-terrain vehicle: means any motor vehicle used for recreational off-road use. See Kentucky Statutes 189.010
  • Allegation: something that someone says happened.
  • Alternative-speed motorcycle: means a motorcycle that: (a) Is self-propelled using an electric motor. See Kentucky Statutes 186.010
  • Amortization: Paying off a loan by regular installments.
  • Anabolic steroid: means any drug or hormonal substance chemically and pharmacologically related to testosterone that promotes muscle growth and includes those substances classified as Schedule III controlled substances pursuant to KRS
    218A. See Kentucky Statutes 218A.010
  • Animal: means all vertebrate and invertebrate species, including but not limited to man and other mammals, birds, fish, and shellfish. See Kentucky Statutes 217.544
  • Annual percentage rate: The cost of credit at a yearly rate. It is calculated in a standard way, taking the average compound interest rate over the term of the loan so borrowers can compare loans. Lenders are required by law to disclose a card account's APR. Source: FDIC
  • Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • Applicable interest rate: means the rate of interest which shall be used as part of the repayment criteria for an assistance agreement between a governmental agency and the authority, and shall be determined by the authority pertinent to the source of funds from which the assistance agreement is funded. See Kentucky Statutes 224A.011
  • Application: means an application submitted by an applicant for a grant from the broadband deployment fund. See Kentucky Statutes 224A.011
  • Approved company: means an eligible company that has received approval from the authority for a sales and use tax incentive under this subchapter. See Kentucky Statutes 154.31-010
  • Approved company: means an eligible company approved under KRS §. See Kentucky Statutes 154.34-010
  • Approved costs: means the eligible equipment and related costs approved by the authority that may be recovered by an approved company through the incentives authorized by this subchapter. See Kentucky Statutes 154.34-010
  • Approved entity: means :
    (a) A motor vehicle dealer licensed under KRS Chapter 190 that applies to and is approved by the Transportation Cabinet to facilitate the title application or salvage title application process through the electronic title application and registration system. See Kentucky Statutes 186A.005
  • Approved public infrastructure costs: includes but is not limited to costs incurred for the following:
    (a) Land preparation, including demolition and clearance work. See Kentucky Statutes 154.30-010
  • Approved signature project costs: means :
    (a) The acquisition of land for portions of the project that are for infrastructure. See Kentucky Statutes 154.30-010
  • Arabian: means a horse that is registered with the Arabian Horse Registry of
    Denver, Colorado. See Kentucky Statutes 230.210
  • Area median income: means the greater of the statewide median family income or the median family income for the area in which the residence is located, as calculated each year by the federal Department of Housing and Urban Development for use in determining eligibility for housing programs. See Kentucky Statutes 198A.010
  • Arraignment: A proceeding in which an individual who is accused of committing a crime is brought into court, told of the charges, and asked to plead guilty or not guilty.
  • Arrest: Taking physical custody of a person by lawful authority.
  • Asset management plan: means a plan for the water and wastewater utility that includes:
    (a) Identification of all the capital assets owned by or used in the operations of the utility. See Kentucky Statutes 224A.011
  • Assistance agreement: means the agreement to be made and entered into by and between a governmental agency or a private entity and the authority, as authorized by this chapter, providing for a lease, loan, services, or grant to a governmental agency or a private entity or for the purchase of obligations issued by the governmental agency, and for the repayment thereof to the authority by the governmental agency or a private entity. See Kentucky Statutes 224A.011
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Attic: means the space between the ceiling beams of the top habitable story and the roof rafters. See Kentucky Statutes 198B.010
  • Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
  • Authority: means the Kentucky Infrastructure Authority, which is created by this chapter. See Kentucky Statutes 224A.011
  • Authority: means the state authority, or a bi-state authority, or a project authority, unless the specific use requires that it apply only to the state authority, or a bi-state authority, or a project authority. See Kentucky Statutes 175B.010
  • Authority: means the Kentucky Economic Development Finance Authority. See Kentucky Statutes 154.31-010
  • Authority revenues: means the totality of all: (a) Service charges. See Kentucky Statutes 224A.011

    (a) Is equipped with a seat that does not require the operator to straddle or sit astride it. See Kentucky Statutes 186.010
  • Automotive mobility dealer: means any motor vehicle dealer who:
    (a) Exclusively engages in the business of selling, offering to sell, or soliciting or advertising the sale of adapted vehicles. See Kentucky Statutes 190.010
  • Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
  • Balanced budget: A budget in which receipts equal outlays.
  • Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
  • Basement: means that portion of a building the average height of which is at least half below grade, which is ordinarily used for purposes such as storage, laundry facilities, household tool shops, and installation and operation of heating, cooling, and ventilating facilities, but which is not ordinarily used for purposes of general household habitation. See Kentucky Statutes 198B.010
  • Bequest: Property gifted by will.
  • Bi-state authority: means an authority created under KRS §. See Kentucky Statutes 175B.010
  • Biennial highway construction plan: means the specifically identified individual transportation projects or portions thereof identified for funding during the upcoming biennium, which correspond to the first two (2) years of the six (6) year road plan. See Kentucky Statutes 176.010
  • Board: means the body created by KRS §. See Kentucky Statutes 201.010
  • Board: means the Pesticide Advisory Board. See Kentucky Statutes 217.544

  • Boxing: means a contest or exhibition in which a person delivers blows with the fist that may be reasonably expected to disable or inflict injury and in which boxers compete for money, a prize, or other pecuniary gain, or for which admission is charged to spectators.   • Branch frozen food locker plant: means a location or establishment in which space in individual lockers is rented to persons for storage of frozen food after preparation for storage at a frozen food locker plant. See Kentucky Statutes 221.010
  • Bridge: includes the bridge and the approaches thereto. See Kentucky Statutes 181.010
  • Broadband deployment fund: means a fund to assist with the construction, development, or improvement of broadband infrastructure, broadband services, or technologies that constitute a part of, or are related to, broadband infrastructure or broadband services, to provide for broadband service in underserved or unserved areas of the Commonwealth.   • Building: means any combination of materials, whether portable or fixed,
    which comprises a structure or nonmine underground area affording facilities or shelter for any human occupancy, whether infrequent or regular, and also means single-family dwellings, including those sold or constructed under a trade or brand name. See Kentucky Statutes 198B.010
  • Cabinet: means the Kentucky Cabinet for Health and Family Services. See Kentucky Statutes 202A.011

    (a) Obligations incurred for labor and to contractors, subcontractors, builders, and materialmen in connection with the acquisition, construction, installation, equipping, and rehabilitation of a project. See Kentucky Statutes 154.30-010
  • Capital offense: A crime punishable by death.
  • Cardholder: means :
    (a) A registered qualified patient, designated caregiver, or visiting qualified patient who has applied for, obtained, and possesses a valid registry identification card issued by the cabinet. See Kentucky Statutes 218B.010
  • Caretaker: means an individual or institution who has been entrusted with or who has the responsibility for the care of the adult as a result of family relationship, or who has assumed the responsibility for the care of the adult person voluntarily or by contract, employment, legal duty, or agreement. See Kentucky Statutes 209.020
  • Carfentanil: means any substance containing any quantity of carfentanil, or any of its salts, isomers, or salts of isomers. See Kentucky Statutes 218A.010
  • Case law: The law as laid down in cases that have been decided in the decisions of the courts.
  • Certificate: means the certificate of birth, death, stillbirth, marriage, dissolution of marriage, or annulment as required by this chapter. See Kentucky Statutes 213.011
  • Certified building inspector: means a person who has been certified by the department as having successfully completed the test requirements provided by KRS §. See Kentucky Statutes 198B.010
  • Certified mail: means any method of governmental, commercial, or electronic delivery that allows a document or package to have proof of:
    (a) Sending the document or package. See Kentucky Statutes 446.010
  • Certified plans and specifications inspector: means a person who has been certified by the department as having successfully completed the test requirements provided by KRS §. See Kentucky Statutes 198B.010
  • Certified plumbing inspector: means a person who has been certified by the department as having successfully completed the test requirements provided by KRS §. See Kentucky Statutes 198B.010
  • Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
  • Child: means any person under the age of majority as specified in KRS §. See Kentucky Statutes 218A.010
  • Child: means any person who has not reached his eighteenth birthday. See Kentucky Statutes 199.011
  • Child-caring facility: means any institution or group home, including institutions and group homes that are publicly operated, providing residential care on a twenty-four (24) hour basis to children, not related by blood, adoption, or marriage to the person maintaining the facility, other than an institution or group home certified by an appropriate agency as operated primarily for educational or medical purposes, or a residential program operated or contracted by the Department of Juvenile Justice that maintains accreditation, or obtains accreditation within two (2) years of opening from a nationally recognized accrediting organization.   • Child-placing agency: means any agency licensed by the cabinet, which supervises the placement of children in foster family homes or child-caring facilities, or which places children for adoption. See Kentucky Statutes 199.011
  • Chiropractor: means a person authorized to practice chiropractic under the laws of the Commonwealth. See Kentucky Statutes 205.510
  • Circumstantial evidence: All evidence except eyewitness testimony.
  • City: means any incorporated city. See Kentucky Statutes 183.012
  • Classification: means the systematic assignment of a prisoner to a custody level, program, and penitentiary. See Kentucky Statutes 197.010
  • Client: means a person who has an open case file with a nonprofit organization or governmental agency and who meets the standards for disability or disadvantaging condition as established in administrative regulations promulgated by the commission pursuant to KRS §.   • Coal severing and processing: means activities resulting in the eligible company being subject to the tax imposed by KRS Chapter 143. See Kentucky Statutes 154.31-010

  • Construction: includes reconstruction and improvement. See Kentucky Statutes 178.010
  • Construction: means the erection, fabrication, reconstruction, substantial alteration or conversion of a building, or the installation of equipment therein, but shall not include the ordinary repair of a building or structure. See Kentucky Statutes 198B.010
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: means the Kentucky Housing Corporation created by this chapter. See Kentucky Statutes 198A.010
  • Cost: means :
    (a) The cost of construction of the project, including the acquisition of land, rights-of-way, property, rights in land, easements, and interests acquired by the authority for construction of a project. See Kentucky Statutes 175B.010
  • Council: means the Advisory Council for Medical Assistance. See Kentucky Statutes 205.510
  • Counterclaim: A claim that a defendant makes against a plaintiff.
  • Counterfeit substance: means a controlled substance which, or the container or labeling of which, without authorization, bears the trademark, trade name, or other identifying mark, imprint, number, or device, or any likeness thereof, of a manufacturer, distributor, or dispenser other than the person who in fact manufactured, distributed, or dispensed the substance. See Kentucky Statutes 218A.010
  • County: means any county, consolidated local government, charter county, unified local government, or urban-county government. See Kentucky Statutes 154.30-010
  • County engineer: means county road engineer. See Kentucky Statutes 179.010
  • County roads: includes necessary bridges, culverts, sluices, drains, ditches, waterways, embankments or retaining walls. See Kentucky Statutes 178.010
  • Court: means the Circuit Court or the District Court if no judge of that Circuit

  • CPI: means the nonseasonally adjusted Consumer Price Index for all urban consumers, all items, base year computed for 1982 to 1984 equals one hundred (100), published by the United States Department of Labor, Bureau of Labor Statistics. See Kentucky Statutes 154.30-010
  • Credit report: A detailed report of an individual's credit history prepared by a credit bureau and used by a lender in determining a loan applicant's creditworthiness. Source: OCC
  • Cross examine: Questioning of a witness by the attorney for the other side.
  • Crosswalk: means :
    (a) That part of a roadway at an intersection within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs or in the absence of curbs, from the edges of the traversable roadway. See Kentucky Statutes 189.010
  • Cultivator: means an entity licensed as such under KRS §. See Kentucky Statutes 218B.010
  • Cultivator agent: means a principal officer, board member, employee, volunteer, or agent of a cultivator. See Kentucky Statutes 218B.010
  • Dams: means any artificial barrier, including appurtenant works, which does or can impound or divert water, and which either:
    (a) Is or will be twenty-five (25) feet or more in height from the natural bed of the stream or watercourse at the downstream toe of the barrier, as determined by the Energy and Environment Cabinet. See Kentucky Statutes 224A.011
  • Danger: means substantial physical harm or threat of substantial physical harm upon self or others. See Kentucky Statutes 202C.010
  • Dead body: means a human body or parts of the human body from the condition of which it reasonably may be concluded that death recently occurred. See Kentucky Statutes 213.011
  • Deaf or hard-of-hearing: means having a hearing impairment so that a person cannot hear and understand speech clearly through the ear alone, irrespective of the use of any hearing aid device. See Kentucky Statutes 210.005
  • Dealer: means any person engaging in the business of buying or selling motor vehicles. See Kentucky Statutes 186.010
  • Dealer agreement: means a written agreement or contract entered into between a new recreational vehicle manufacturer and a new recreational vehicle dealer that fixes the rights and responsibilities of the parties and pursuant to which the dealer has the exclusive right to sell specific line-makes and models of the manufacturer's new recreational vehicles.   • Decedent: A deceased person.
  • Deception: means but is not limited to:
    (a) Creating or reinforcing a false impression, including a false impression as to law, value, intention, or other state of mind. See Kentucky Statutes 209.020
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Defense attorney: Represent defendants in criminal matters.
  • Defoliant: means any substance or mixture of substances intended to cause the leaves or foliage to drop from a plant, with or without causing abscission. See Kentucky Statutes 217.544
  • Department: means the Department for Community Based Services. See Kentucky Statutes 199.011
  • Department: means the Department of Highways. See Kentucky Statutes 175B.010

  • Desiccant: means any substance or mixture of substances intended to artificially accelerate the drying of plant tissue. See Kentucky Statutes 217.544
  • Designated caregiver: means a person who has registered as such with the cabinet under KRS §. See Kentucky Statutes 218B.010
  • Designated family member: means the spouse, child, grandchild, parent, brother, or sister of a dealer who, in the case of a deceased dealer, is entitled to inherit the dealer's ownership interest in the dealership under the terms of the dealer's will. See Kentucky Statutes 190.010
  • Developing authority: means the authority involved in the development of a project. See Kentucky Statutes 175B.010
  • Development area: means an area established under KRS §. See Kentucky Statutes 154.30-010
  • Development costs: means the costs approved by the corporation as appropriate expenditures and credits which may be incurred by sponsors of residential housing, prior to commitment and initial advance of the proceeds of a construction loan or of a mortgage loan, including but not limited to:
    (a) Payments for options to purchase properties on the proposed residential housing site, deposits on contracts of purchase, or, with prior approval of the corporation, payments for the purchase of properties. See Kentucky Statutes 198A.010
  • Device: means any instrument or contrivance other than a firearm which is intended for trapping, destroying, repelling, or mitigating any pest or any other form of plant or animal life other than man and other bacteria, virus, or other microorganisms on or in living man or other living animals.   • Devise: To gift property by will.
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • Dispensary: means an entity licensed as such under KRS §. See Kentucky Statutes 218B.010
  • Dispensary agent: means a principal officer, board member, employee, volunteer, or agent of a dispensary. See Kentucky Statutes 218B.010
  • Dispense: means to deliver a controlled substance to an ultimate user or research subject by or pursuant to the lawful order of a practitioner, including the packaging, labeling, or compounding necessary to prepare the substance for that delivery. See Kentucky Statutes 218A.010
  • Dispenser: means a person who lawfully dispenses a Schedule II, III, IV, or V
    controlled substance to or for the use of an ultimate user. See Kentucky Statutes 218A.010
  • Disqualifying felony offense: means :
    (a) A felony offense that would classify the person as a violent offender under
    KRS §. See Kentucky Statutes 218B.010
  • Distribute: means to offer for sale, hold for sale, sell, barter, ship, deliver for shipment, or receive and, having received, deliver or offer to deliver pesticides in this state. See Kentucky Statutes 217.544
  • Distribute: means to deliver other than by administering or dispensing a controlled substance. See Kentucky Statutes 218A.010
  • Distribution facilities: means all or any part of any facilities, devices, and systems used and useful in obtaining, pumping, storing, treating, and distributing water for agricultural, industrial, commercial, recreational, public, and domestic use. See Kentucky Statutes 224A.011
  • Distributor: which means any person, firm, association, corporation, or trust, resident or nonresident, who in whole or in part offers for sale, sells, or distributes any new motor vehicle to new motor vehicle dealers, or who maintains factory representatives, or who controls any person, firm, association, corporation, or trust, resident or nonresident, who in whole or in part offers for sale, sells, or distributes any new motor vehicle to new motor vehicle dealers.   • Distributor branch: which means a branch office similarly maintained by a distributor or wholesaler for the same purposes. See Kentucky Statutes 190.010
  • Distributor representative: which means a representative similarly employed by a distributor, distributor branch, or wholesaler. See Kentucky Statutes 190.010
  • Docket: A log containing brief entries of court proceedings.
  • Dosage unit: means a single pill, capsule, ampule, liquid, or other form of administration available as a single unit. See Kentucky Statutes 218A.010
  • Drug: means :
    (a) Substances recognized as drugs in the official United States Pharmacopoeia, official Homeopathic Pharmacopoeia of the United States, or official National Formulary, or any supplement to any of them. See Kentucky Statutes 218A.010
  • Economic development project: means :

  • Electric low-speed scooter: means a device that: (a) Weighs less than one hundred (100) pounds. See Kentucky Statutes 189.010
  • Electric vehicle: means any vehicle that has plug-in charging capability, regardless of whether the vehicle is powered by:
    (a) An electric motor only. See Kentucky Statutes 186.010
  • Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash.   • Electronic processing: means the use of technology having electronic, digital, magnetic, wireless, optical, electromagnetic, or similar capabilities, now in existence or later developed to perform a service or technology activity. See Kentucky Statutes 154.31-010
  • Electronic title application and registration system: means a system established under KRS §. See Kentucky Statutes 186A.005
  • Eligible company: means any corporation, limited liability company, partnership, limited partnership, sole proprietorship, business trust, or other legal entity with a proposed economic development project that is primarily engaged in or planning to be engaged in one (1) or more of the following activities within the Commonwealth:

  • Eligible equipment and related costs: means :

  • Eligible sexual offender: means a sexual offender for whom the sentencing court, department officials, or both have determined that he or she:
    (a) Has demonstrated evidence of a mental, emotional, or behavioral disorder, but not active psychosis or an intellectual disability. See Kentucky Statutes 197.010
  • Embezzlement: In most states, embezzlement is defined as theft/larceny of assets (money or property) by a person in a position of trust or responsibility over those assets. Embezzlement typically occurs in the employment and corporate settings. Source: OCC
  • Emergency: means that an adult is living in conditions which present a substantial risk of death or immediate and serious physical harm to himself or herself or others. See Kentucky Statutes 209.020
  • Employee: includes agents, servants and independent contractors. See Kentucky Statutes 181.010
  • Energy and Environment Cabinet: means the Kentucky Energy and Environment Cabinet, or its successor, said term being meant to relate specifically to the state agency which is designated as the water pollution agency for the Commonwealth of Kentucky, for purposes of the federal act. See Kentucky Statutes 224A.011
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Environment: includes water, air, land, and all plants and man and other animals living therein and the interrelationships which exist among these. See Kentucky Statutes 217.544
  • EPA: means the United States Environmental Protection Agency. See Kentucky Statutes 217.544
  • Equipment: means facilities or installations, including but not limited to heating, electrical, ventilating, air conditioning, and refrigerating facilities or installations. See Kentucky Statutes 198B.010
  • Equipment: means manufacturing machinery equipment, computers, furnishings, fixtures, and other assets installed by the approved company as part of the reinvestment project. See Kentucky Statutes 154.34-010
  • Escheat: Reversion of real or personal property to the state when 1) a person dies without leaving a will and has no heirs, or 2) when the property (such as a bank account) has been inactive for a certain period of time. Source: OCC
  • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • Established place of business: means a permanent, enclosed commercial building located within this state, easily accessible and open to the public at all reasonable times, and at which the business of a vehicle dealer, including the display and repair of vehicles, may be lawfully carried on in accordance with the terms of all applicable building codes, zoning, and other land use regulatory ordinances.   • Evidence-based practices: means policies, procedures, programs, and practices proven by scientific research to reliably produce reductions in recidivism when implemented competently. See Kentucky Statutes 446.010
  • Evidentiary hearing: means the hearing under KRS §. See Kentucky Statutes 202C.010
  • Executive director: means the chief administrator of Shaping Our Appalachian Region, Inc. See Kentucky Statutes 154.33-510
  • Executor: A male person named in a will to carry out the decedent
  • Exhibition: means an event or engagement:
    (a) In which the participants show or display their skills without necessarily striving to win. See Kentucky Statutes 229.011
  • Exploitation: means obtaining or using another person's resources, including but not limited to funds, assets, or property, by deception, intimidation, or similar means, with the intent to deprive the person of those resources. See Kentucky Statutes 209.020
  • Extradition: The formal process of delivering an accused or convicted person from authorities in one state to authorities in another state.
  • Factory branch: which means a branch office maintained by a manufacturer for the purpose of selling, or offering for sale, new motor vehicles to a distributor, wholesaler, or new motor vehicle dealer, or for directing or supervising, in whole or in part, factory or distributor representatives, and shall further include any sales promotion organization, whether the same be a person, firm, or corporation, which is engaged in promoting the sale of new motor vehicles in this state of a particular brand or make to new motor vehicle dealers. See Kentucky Statutes 190.010
  • Factory branch: means a branch office maintained by a manufacturer for the purpose of selling, or offering for sale, new recreational vehicles to a distributor, wholesaler, or new recreational vehicle dealer, or for directing or supervising, in whole or in part, factory representatives, and shall further include any sales promotion organization, whether it is a person, firm, or corporation, which is engaged in promoting the sale of new recreational vehicles in this state of a particular line-make to new recreational vehicle dealers. See Kentucky Statutes 190A.010
  • Factory campaign: means an effort by a new recreational vehicle warrantor to contact recreational vehicle owners or recreational vehicle dealers in order to address an issue concerning a recreational vehicle problem, defective part, or equipment. See Kentucky Statutes 190A.010
  • Factory representative: which means a representative employed by a manufacturer, distributor, or factory branch for the purpose of making or promoting for the sale of his or her, its, or their new motor vehicles, or for supervising or contracting with his or her, its, or their dealers, or prospective dealers. See Kentucky Statutes 190.010
  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • Federal act: means the Federal Clean Water Act, 33 U. See Kentucky Statutes 224A.011
  • Federal Aviation Administration: shall mean that agency or board of the United States government empowered to regulate operation of aircraft. See Kentucky Statutes 183.010
  • Federally assisted wastewater revolving fund: means that fund which will receive federal and state funds or the proceeds from the sale of revenue bonds of the authority for the purpose of providing loans to finance construction of publicly owned treatment works as defined in Section 212 of the federal act and for the implementation of a management program established under Section 319 of the federal act and for the development and implementation of a conservation and management plan under Section 320 of the federal act.   • Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
  • Fentanyl: means a substance containing any quantity of fentanyl, or any of its salts, isomers, or salts of isomers. See Kentucky Statutes 218A.010
  • Fetal death: means death prior to the complete expulsion or extraction from its mother of a product of human conception, irrespective of the duration of pregnancy. See Kentucky Statutes 213.011
  • Fictive kin: means an individual who is not related by birth, adoption, or marriage to a child, but who has an emotionally significant relationship with the child, or an emotionally significant relationship with a biological parent, siblings, or half-siblings of the child in the case of a child from birth to twelve (12) months of age, prior to placement.   • FIFRA: means the Federal Insecticide, Fungicide and Rodenticide Act as amended. See Kentucky Statutes 217.544
  • File: means the presentation of a vital record provided for in this chapter for registration by the Vital Statistics Branch. See Kentucky Statutes 213.011
  • Final approval: means the action taken by the authority designating a preliminarily approved eligible company as an approved company to receive incentives under this subchapter. See Kentucky Statutes 154.34-010

  • Financing costs: means principal, interest, costs of issuance, debt service reserve requirements, underwriting discount, costs of credit enhancement or liquidity instruments, and other costs directly related to the issuance of bonds or debt for approved public infrastructure costs or approved signature project costs for projects approved pursuant to KRS §.   • Fleet: means :
    (a) A group of at least one hundred fifty (150) U-Drive-It vehicles owned by the holder of a U-Drive-It certificate. See Kentucky Statutes 186A.005
  • Footprint: means the actual perimeter of a discrete, identified project within a development area. See Kentucky Statutes 154.30-010
  • Forbearance: A means of handling a delinquent loan. A
  • Forensic psychiatric facility: means a mental institution or facility, or part thereof, designated by the secretary for the purpose and function of providing inpatient evaluation, care, and treatment for mentally ill persons or individuals with an intellectual disability, who have been charged with or convicted of a felony.   • Forensic psychiatric facility: means a mental institution or facility, or part thereof, designated by the secretary for the purpose and function of providing inpatient evaluation, care, and treatment for mentally ill persons or individuals with an intellectual disability who have been charged with or convicted of a felony.   • Foster family home: means a private home in which children are placed for foster family care under supervision of the cabinet or of a licensed child-placing agency. See Kentucky Statutes 199.011
  • Franchise: means the agreement or contract between any new motor vehicle manufacturer, written or otherwise, and any new motor vehicle dealer that purports to fix the legal rights and liabilities of the parties to an agreement or contract, and pursuant to which the dealer purchases and resells the franchise product, along with any addendums to the franchise agreement. See Kentucky Statutes 190.010
  • Fraud: Intentional deception resulting in injury to another.
  • Frozen food locker plant: means a location or establishment in which space in individual lockers is rented to persons for storage of frozen food and which is equipped with a chill room, sharp-freezing facilities, and facilities for cutting, preparing, wrapping, and packaging meats and meat products, fruits, and vegetables. See Kentucky Statutes 221.010
  • Fund notes: means the notes authorized to be issued by the corporation under the provisions of KRS §. See Kentucky Statutes 198A.010
  • Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
  • Geofence: means a virtual geographic boundary defined by Global Positioning
    System (GPS) or Radio Frequency Identification (RFID) technology. See Kentucky Statutes 230.210
  • Germane: On the subject of the pending bill or other business; a strict standard of relevance.
  • Good faith: means honesty in fact, and the observance of reasonable commercial standards of fair dealing in the trade, as is defined and interpreted in KRS §. See Kentucky Statutes 190.010
  • Governing body: means the body possessing legislative authority in a city or county. See Kentucky Statutes 154.30-010
  • Governmental agency: means any incorporated city or municipal corporation, or other agency, or unit of government within or a department or a cabinet of the Commonwealth of Kentucky, now having or hereafter granted, the authority and power to finance, acquire, construct, or operate infrastructure or solid waste projects. See Kentucky Statutes 224A.011
  • Governmental agency: means any city, county, or other political subdivision of the Commonwealth, the Commonwealth and any department, division, or public agency thereof, the federal government or any political subdivision of any other state, any public housing authority or any nonprofit corporation or other entity legally empowered to act on behalf of any of the foregoing to perform the duties of a public
    housing authority, or any two (2) or more thereof. See Kentucky Statutes 198A.010
  • governmental unit: means any city, or the combination of any two (2) or more thereof, or any county, urban-county government, or combination of two (2) or more such counties, city or cities, acting jointly with any county or counties or an airboard or board established as provided in this chapter.   • Group home: means a homelike facility, excluding Department of Juvenile Justice-operated or -contracted facilities, for not more than eight (8) foster children, not adjacent to or part of an institutional campus, operated by a sponsoring agency for children who may participate in community activities and use community resources.   • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Habeas corpus: A writ that is usually used to bring a prisoner before the court to determine the legality of his imprisonment. It may also be used to bring a person in custody before the court to give testimony, or to be prosecuted.
  • Hard surface road: means a road the surface of which is asphalt, brick, stone block, macadam, concrete, gravel or other material of equal merit. See Kentucky Statutes 178.010
  • Hazardous chemical substance: includes any chemical substance used or intended for use in the illegal manufacture of a controlled substance as defined in this section or the illegal manufacture of methamphetamine as defined in KRS §. See Kentucky Statutes 218A.010
  • Headquarters: means the principal office where the principal executives of the entity are located and from which other personnel, branches, affiliates, offices, or entities are controlled. See Kentucky Statutes 154.31-010
  • Health professional: means a physician, physician assistant, nurse, doctor of chiropractic, behavioral health professional, optometrist, dentist, or allied health professional who is licensed in Kentucky. See Kentucky Statutes 205.510
  • Heroin: means a substance containing any quantity of heroin, or any of its salts, isomers, or salts of isomers. See Kentucky Statutes 218A.010
  • High hazard occupancy: means the occupancy or use of a building or structure or any portion thereof that involves highly combustible, highly flammable, or explosive materials or which has inherent characteristics that constitute a special fire hazard, including among others:
    (a) Aluminum powder factories. See Kentucky Statutes 198B.010
  • Highway: means every way or place of whatever nature when any part of it is open to the use of the public, as a matter of right, license, or privilege, for the purpose of vehicular traffic. See Kentucky Statutes 186.010
  • Highway work zone: means that lane or portion of a state-maintained highway open to vehicular traffic and the affected area adjacent to a lane, berm, or shoulder of a state-maintained highway upon which construction, reconstruction, resurfacing, maintenance, inspection, or other work of that nature is being conducted. See Kentucky Statutes 189.010
  • Home: means the institution to be established and maintained in any county having a city of the first class, in conformity with the provisions of this chapter. See Kentucky Statutes 201.010
  • Hospital: means :
    (a) A state mental hospital or institution or other licensed public or private hospital, institution, health-care facility, or part thereof, approved by the Kentucky Cabinet for Health and Family Services as equipped to provide full- time residential care and treatment for mentally ill persons or individuals with an intellectual disability. See Kentucky Statutes 202A.011
  • Hospital: means :
    (a) A state mental hospital or institution or other licensed public or private hospital, institution, health-care facility, or part thereof, approved by the Kentucky Cabinet for Health and Family Services as equipped to provide full- time residential care and treatment for mentally ill persons or individuals with an intellectual disability. See Kentucky Statutes 202B.010
  • Hospital: means :
    (a) A state mental hospital or institution or other licensed public or private hospital, institution, health-care facility, or part thereof, approved by the Kentucky Cabinet for Health and Family Services as equipped to provide full-time residential care and treatment for mentally ill persons or individuals with an intellectual disability. See Kentucky Statutes 202C.010
  • Hospital: means an establishment with organized medical staff and permanent facilities with inpatient beds which provide medical services, including physician services and continuous nursing services for the diagnosis and treatment of patients who have a variety of medical conditions, both surgical and nonsurgical. See Kentucky Statutes 222.005
  • Host track: means the track conducting racing and offering its racing for intertrack wagering, or, in the case of interstate wagering, means the Kentucky track conducting racing and offering simulcasts of races conducted in other states or foreign countries. See Kentucky Statutes 230.210
  • house of prostitution: means any building, erection or other place used for the purpose of lewdness, assignation or prostitution. See Kentucky Statutes 233.010
  • Housing development fund: means the housing development fund created by KRS
    198A. See Kentucky Statutes 198A.010
  • Identity document: means an instruction permit, operator's license, or personal identification card issued under KRS §. See Kentucky Statutes 186.010
  • Ignition interlock certificate of installation: means a certificate providing that the installed ignition interlock device has been installed and is certified for use in the Commonwealth under KRS §. See Kentucky Statutes 189A.005
  • Ignition interlock license: means a motor vehicle or motorcycle operator's license issued or granted by the laws of the Commonwealth of Kentucky that, except for those with an employer exemption under KRS §. See Kentucky Statutes 189A.005
  • Immediate precursor: means a substance which is the principal compound commonly used or produced primarily for use, and which is an immediate chemical intermediary used or likely to be used in the manufacture of a controlled substance or methamphetamine, the control of which is necessary to prevent, curtail, or limit manufacture. See Kentucky Statutes 218A.010
  • Imminent hazard: means a situation which exists when the continued use of a pesticide would likely result in unreasonable adverse effects on the environment or will involve unreasonable hazard to the survival of a species declared endangered by the secretary of the United States Department of
    Interior under Pub. See Kentucky Statutes 217.544
  • In forma pauperis: In the manner of a pauper. Permission given to a person to sue without payment of court fees on claim of indigence or poverty.
  • In-person: includes telehealth examinations. See Kentucky Statutes 218A.010
  • Incentives: means the Kentucky tax credit as prescribed in this subchapter. See Kentucky Statutes 154.34-010
  • Increment bonds: means bonds and notes issued for the purpose of paying the costs of one (1) or more projects. See Kentucky Statutes 154.30-010
  • Incremental revenues: means :
    (a) The amount of revenues received by a taxing district, as determined by subtracting old revenues from new revenues in a calendar year with respect to a development area, or a project within a development area. See Kentucky Statutes 154.30-010
  • Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • Individual with an intellectual disability: means a person with significantly subaverage general intellectual functioning existing concurrently with deficits in adaptive behavior and manifested during the developmental period. See Kentucky Statutes 202B.010
  • Industrial occupancy: means the occupancy or use of a building structure or any portion thereof for assembling, fabricating, finishing, manufacturing, packaging, or processing operations, except for occupancies of high hazard, including among others:
    (a) Assembly plants. See Kentucky Statutes 198B.010
  • Industrial waste: means any liquid, gaseous, or solid waste substances resulting from any process of industry, manufacture, trade, or business, or from the mining or taking, development, processing, or recovery of any natural resources, including
    heat and radioactivity, together with any sewage as is present therein, which pollutes the waters of the state, and specifically, but not by way of limitation, means heat or thermal differentials created in the waters of the state by any industrial processing, generating, or manufacturing processes. See Kentucky Statutes 224A.011
  • Infrastructure project: means any construction or acquisition of treatment works, facilities related to the collection, transportation, and treatment of wastewater as defined in KRS §. See Kentucky Statutes 224A.011
  • Infrastructure revolving fund: means that fund which will receive state funds, the proceeds from the sale of revenue bonds of the authority or other moneys earmarked for that fund for the purpose of providing loans or grants to finance construction or acquisition of infrastructure projects as defined in this section. See Kentucky Statutes 224A.011
  • Ingredient statement: means a statement of the name and percentage of each active ingredient together with the total percentage of the inert ingredients in the pesticide and, when the pesticide contains arsenic in any form, a statement of the percentage of total and water-soluble arsenic, each stated as elemental arsenic. See Kentucky Statutes 217.544
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Insect: means any of the numerous small invertebrate animals generally having the body more or less obviously segmented, for the most part belonging to the class insecta, comprising six (6) legged, usually winged forms, as for example, beetles, bugs, bees, flies, and to other allied classes of arthropods whose members are wingless and usually have more than six (6) legs, as, for example, spiders, mites, ticks, centipedes, and wood lice, also nematodes and other invertebrates which are destructive, constitute a liability, and may be classed as pests. See Kentucky Statutes 217.544
  • Institution: means a child-caring facility providing care or maintenance for nine
    (9) or more children. See Kentucky Statutes 199.011
  • Institution: means any establishment, public or private, which provides inpatient medical, surgical, or diagnostic care or treatment or nursing, custodial, or domiciliary care, or to which persons are committed by law. See Kentucky Statutes 213.011
  • Instruction permit: includes both motor vehicle instruction permits and motorcycle instruction permits. See Kentucky Statutes 186.010
  • Interdisciplinary team: means the group of persons responsible for the diagnosis, evaluation, and individualized program planning and service implementation for the resident. See Kentucky Statutes 202B.010
  • Intersection: means :
    (a) The area embraced within the prolongation or connection of the lateral curb lines, or, if none, then the lateral boundary lines of the roadways of two (2) highways which join one another, but do not necessarily continue, at approximately right angles, or the area within which vehicles traveling upon different highways joining at any other angle may come into conflict. See Kentucky Statutes 189.010
  • Interstate wagering: means pari-mutuel wagering on simulcast horse races from a track located in another state or foreign country by patrons at a receiving track or simulcast facility. See Kentucky Statutes 230.210
  • Intertrack wagering: means pari-mutuel wagering on simulcast horse races from a host track by patrons at a receiving track. See Kentucky Statutes 230.210
  • Intestate: Dying without leaving a will.
  • Intoxication: means being under the influence of alcohol or other drugs, or both, which significantly impairs a person's ability to function. See Kentucky Statutes 222.005
  • Investigation: shall include but is not limited to:
    (a) A personal interview with the individual reported to be abused, neglected, or exploited. See Kentucky Statutes 209.020
  • Issuing authority: means the authority that will issue or has issued debt associated with a project. See Kentucky Statutes 175B.010
  • Joint resolution: A legislative measure which requires the approval of both chambers.
  • Joint tenancy: A form of property ownership in which two or more parties hold an undivided interest in the same property that was conveyed under the same instrument at the same time. A joint tenant can sell his (her) interest but not dispose of it by will. Upon the death of a joint tenant, his (her) undivided interest is distributed among the surviving joint tenants.
  • Judge: means any judge or justice of the Court of Justice or a trial commissioner of the District Court acting under authority of SCR 5. See Kentucky Statutes 202A.011
  • Judge: means any judge or justice of the Court of Justice or a trial commissioner of the District Court acting under authority of SCR 5. See Kentucky Statutes 202B.010
  • Judge: means the judge who found the respondent incompetent to stand trial in the criminal proceeding from which the petition for involuntary commitment arose. See Kentucky Statutes 202C.010
  • Judgement: The official decision of a court finally determining the respective rights and claims of the parties to a suit.
  • Judgment: means any judgment which has become final by expiration without appeal of the time within which an appeal might have been perfected, or by final affirmation on appeal, rendered by a court of competent jurisdiction of any state or of the United States, upon a cause of action arising out of the ownership, maintenance or use of any motor vehicle, for damages, including damages for care and loss of services, because of bodily injury to or death of any person, or for damages because of injury to or destruction of property, including the loss of use thereof, or upon a cause of action on an agreement of settlement for such damages. See Kentucky Statutes 187.290
  • Kickboxing: means a boxing contest or exhibition where the participants are allowed to throw kicks or foot blows at the opponent in addition to punching with the hands and in which kickboxers compete for money, a prize, or other pecuniary gain, or for which admission is charged to spectators. See Kentucky Statutes 229.011
  • Label: means the written, printed, or graphic matter on, or attached to, the pesticide or device, or to any of its containers or wrappers. See Kentucky Statutes 217.544
  • Labeling: means the label and other written, printed, or graphic matter: (a) On the pesticide or device, or any of its containers or wrappers. See Kentucky Statutes 217.544
  • Land: means all land and water areas, including air space and all plants, animals, structures, buildings, contrivances, and machinery appurtenant thereto, or situated thereon, fixed or mobile, including any used for transportation. See Kentucky Statutes 217.544
  • Land development: means the process of acquiring land primarily for residential housing construction for persons and families of lower and moderate income and making, installing, or constructing nonresidential housing improvements, including water, sewer, and other utilities, roads, streets, curbs, gutters, sidewalks, storm drainage facilities, and other installations or works, whether on or off the site, which the corporation deems necessary or desirable to prepare the land primarily for residential housing construction. See Kentucky Statutes 198A.010
  • Law enforcement officer: means a member of a lawfully organized police unit or police force of county, city, or metropolitan government who is responsible for the detection of crime and the enforcement of the general criminal laws of the state, as well as a sheriff, sworn deputy sheriff, campus police officer, law enforcement support personnel, public airport authority security officer, other public and federal peace officer responsible for law enforcement, special local peace officer appointed pursuant to KRS §. See Kentucky Statutes 209A.020
  • Lawsuit: A legal action started by a plaintiff against a defendant based on a complaint that the defendant failed to perform a legal duty, resulting in harm to the plaintiff.
  • Least restrictive alternative mode of treatment: means that treatment which will give a mentally ill individual a realistic opportunity to improve the individual's level of functioning, consistent with accepted professional practice in the least confining setting available. See Kentucky Statutes 202A.011
  • Least restrictive alternative mode of treatment: means that treatment given in the least confining setting which will provide an individual with an intellectual disability appropriate treatment or care consistent with accepted professional practice. See Kentucky Statutes 202B.010
  • Legislative session: That part of a chamber's daily session in which it considers legislative business (bills, resolutions, and actions related thereto).
  • License: means any operator's license, temporary instruction permit, or temporary license issued under the laws of this state pertaining to the licensing of operators. See Kentucky Statutes 187.290
  • License: means any driver's or operator's license or any other license or permit to operate a motor vehicle issued under or granted by the laws of this state including:
    (a) Any temporary license or instruction permit. See Kentucky Statutes 189A.005
  • Licensed premises: means a track or simulcast facility licensed by the racing commission under this chapter. See Kentucky Statutes 230.210
  • Licensor: means the commission. See Kentucky Statutes 190.010
  • Line-make: means a specific series of recreational vehicle products that: (a) Are identified by a common series trade name or trademark. See Kentucky Statutes 190A.010
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Livestock: means cattle, sheep, swine, goats, horses, alpacas, llamas, buffaloes, and any other animals of the bovine, ovine, porcine, caprine, equine, or camelid species. See Kentucky Statutes 186.010
  • Livestock: means cattle, sheep, swine, goats, horses, alpacas, llamas, buffaloes, and any other animals of the bovine, ovine, porcine, caprine, equine, or camelid species. See Kentucky Statutes 217.544
  • Livestock: means cattle, sheep, swine, goats, horses, alpacas, llamas, buffaloes, or any other animals of the bovine, ovine, porcine, caprine, equine, or camelid species. See Kentucky Statutes 446.010
  • Loan or grant: means moneys to be made available to governmental agencies by the authority for the purpose of defraying all or any part of the total costs incidental to construction or acquisition of any infrastructure project. See Kentucky Statutes 224A.011
  • Local government: means a consolidated local government, an urban-county government, a charter county government, a unified local government, or a county. See Kentucky Statutes 175B.010
  • Long-term care administrator: means any individual responsible for planning, organizing, directing, and controlling the operation of a licensed long-term care facility, or who in fact performs those functions, whether or not those functions are shared by one (1) or more other persons. See Kentucky Statutes 216A.010
  • Manufacturer: means any person engaged in manufacturing motor vehicles who will, under normal conditions during the year, manufacture or assemble at least ten (10) new motor vehicles. See Kentucky Statutes 186.010
  • Manufacturer: means any person, partnership, firm, association, corporation, or trust, resident or nonresident, who manufactures or assembles new motor vehicles, or imports for distribution through distributors of new motor vehicles, or any partnership, firm, association, joint venture, corporation, or trust, resident or nonresident, which is controlled by the manufacturer. See Kentucky Statutes 190.010
  • Manufacturer: means any person, partnership, firm, association, corporation, or trust, resident or nonresident, who manufactures or assembles new recreational vehicles, or imports for distribution through distributors of new recreational vehicles, or any partnership, firm, association, joint venture, corporation, or trust, resident or nonresident, which is controlled by the manufacturer. See Kentucky Statutes 190A.010
  • Marijuana: means all parts of the plant Cannabis sp. See Kentucky Statutes 218A.010
  • Medicinal cannabis accessories: means any equipment, product, or material of any kind which is used, intended for use, or designed for use in the preparing, storing, using, or consuming medicinal cannabis in accordance with this chapter. See Kentucky Statutes 218B.010
  • Medicinal cannabis practitioner: means a physician or an advanced practice registered nurse who is authorized to prescribe controlled substances under KRS
    314. See Kentucky Statutes 218B.010
  • Mentally ill person: means a person with substantially impaired capacity to use self-control, judgment, or discretion in the conduct of the person's affairs and social relations, associated with maladaptive behavior or recognized emotional symptoms where impaired capacity, maladaptive behavior, or emotional symptoms can be related to physiological, psychological, or social factors. See Kentucky Statutes 202A.011
  • Minimum finance charge: The minimum, or fixed, finance charge that will be imposed during a billing cycle. A minimum finance charge usually applies only when a finance charge is imposed, that is, when you carry over a balance. Source: Federal Reserve
  • Minor: means a person less than eighteen (18) years of age. See Kentucky Statutes 218B.010
  • Misbranded: means a pesticide is misbranded if:
    (a) Its labeling bears any statement, design, or graphic representation relative thereto or to its ingredients which is false or misleading in any particular. See Kentucky Statutes 217.544
  • Mixed martial arts: means any form of unarmed contest or exhibition in which participants compete for money, a prize, or other pecuniary gain, or for which admission is charged to spectators. See Kentucky Statutes 229.011
  • Mobile home: means mobile home as defined in KRS §. See Kentucky Statutes 198B.010
  • Modified new revenues for income tax: means the amount of individual income tax included in state tax revenues that is:
    (a) The result of multiplying the portion of state tax revenues from individual income taxes by the modifier. See Kentucky Statutes 154.30-010
  • Modifier: means the result of dividing the individual income tax rate of five percent (5%), in effect as of December 31, 2022, by the individual income tax rate under KRS §. See Kentucky Statutes 154.30-010
  • Moped: means either a motorized bicycle whose frame design may include one (1) or more horizontal crossbars supporting a fuel tank so long as it also has pedals, or a motorized bicycle with a step-through type frame which may or may not have pedals rated no more than two (2) brake horsepower, a cylinder capacity not exceeding fifty (50) cubic centimeters, an automatic transmission not requiring clutching or shifting by the operator after the drive system is engaged, and capable of a maximum speed of not more than thirty (30) miles per hour. See Kentucky Statutes 186.010
  • Moped: means either a motorized bicycle whose frame design may include one (1) or more horizontal crossbars supporting a fuel tank so long as it also has pedals, or a motorized bicycle with a step-through type frame which may
    or may not have pedals rated no more than two (2) brake horsepower, a cylinder capacity not exceeding fifty (50) cubic centimeters, an automatic transmission not requiring clutching or shifting by the operator after the drive system is engaged, and capable of a maximum speed of not more than thirty (30) miles per hour. See Kentucky Statutes 189.285
  • Moped: means a motorized bicycle with pedals whose frame design may include one (1) or more horizontal crossbars supporting a fuel tank, or a motorized bicycle with pedals and with a step through type frame rated no more than two (2) brake horsepower, a cylinder capacity not exceeding fifty (50) cubic centimeters, an automatic transmission not requiring clutching or shifting by the operator after the drive system is engaged, and capable of a maximum speed of not more than thirty (30) miles per hour. See Kentucky Statutes 190.010
  • Motor scooter: means a low-speed motorcycle that is:
    (a) Equipped with wheels greater than sixteen (16) inches in diameter. See Kentucky Statutes 186.010
  • Motor truck: means any motor-propelled vehicle designed for carrying freight or merchandise. See Kentucky Statutes 189.010
  • Motor vehicle: means in KRS §. See Kentucky Statutes 186.010
  • Motor vehicle: means every self-propelled vehicle which is designed for use upon a highway, including trailers designed for use with such vehicles (except traction engines, road rollers, farm tractors, tractor cranes, power shovels, mopeds, and well drillers) and every vehicle which is propelled by electric power obtained from overhead wires but not operated upon rails. See Kentucky Statutes 187.290
  • Motor vehicle: includes all vehicles, as defined in paragraph (a) of this subsection, except:
    1. See Kentucky Statutes 189.010
  • Motor vehicle: means every vehicle intended primarily for use and operation on the public highways that is self-propelled, including low-speed motor vehicles as defined in KRS §. See Kentucky Statutes 190.010
  • Motor vehicle auction dealer: means any person primarily engaged in the business of offering, negotiating, or attempting to negotiate a sale, purchase, or exchange of a motor vehicle through auction. See Kentucky Statutes 190.010
  • Motor vehicle dealer: means any person not excluded by subsection (3) of this section, engaged in the business of selling, offering to sell, soliciting, or advertising the same, of new or used motor vehicles, or possessing motor vehicles for the purpose of resale, either on his or her own account, or on behalf of another, either as his or her primary business or incidental thereto. See Kentucky Statutes 190.010
  • Motor vehicle salesperson: means any person who is employed as a salesperson by a motor vehicle dealer to sell motor vehicles, or who is employed as an auctioneer by a motor vehicle auction dealer to sell motor vehicles at auction. See Kentucky Statutes 190.010
  • Motor vehicles: means all motor propelled vehicles, except electric and steam railways. See Kentucky Statutes 188.010
  • Motorcycle: means any motor driven vehicle that has a maximum speed that exceeds fifty (50) miles per hour, has a seat or saddle for the use of the operator, and is designed to travel on not more than three (3) wheels in contact with the ground, including vehicles on which the operator and passengers ride in an enclosed cab. See Kentucky Statutes 186.010
  • Motorcycle: means any motor-driven vehicle having a seat or saddle for the use of the operator and designed to travel on not more than three (3) wheels in contact with the ground, but excluding tractors and vehicles on which the operator and passengers ride in an enclosed cab and excluding a moped as defined in this subsection. See Kentucky Statutes 189.285
  • Motorcycle dealer: means a motor vehicle dealer who exclusively sells, offers to sell, solicits, or advertises motorcycles, including alternative-speed motorcycles as defined in KRS §. See Kentucky Statutes 190.010
  • Muay thai: means a boxing contest or exhibition where the participants are allowed combined use of clinches, elbows, knees, and shins in addition to punching with the hands and in which participants compete for money, a prize, or other pecuniary gain, or for which admission is charged to spectators. See Kentucky Statutes 229.011
  • Narcotic drug: means any of the following, whether produced directly or indirectly by extraction from substances of vegetable origin, or independently by means of chemical synthesis, or by a combination of extraction and chemical synthesis:
    (a) Opium and opiate, and any salt, compound, derivative, or preparation of opium or opiate. See Kentucky Statutes 218A.010
  • National Bank: A bank that is subject to the supervision of the Comptroller of the Currency. The Office of the Comptroller of the Currency is a bureau of the U.S. Treasury Department. A national bank can be recognized because it must have "national" or "national association" in its name. Source: OCC
  • Needy aged: means a person who has attained the age of sixty-five (65) and who is unable to provide for himself and who does not have otherwise provided for him a subsistence compatible with decency and health. See Kentucky Statutes 205.010
  • Needy blind: means a person who has no vision or whose vision is so defective as to prevent the performance of ordinary activities for which eyesight is essential and who is unable to provide for himself and who does not have otherwise provided for him a subsistence compatible with decency and health. See Kentucky Statutes 205.010
  • Needy child: means a child who has been deprived of parental support by reasons prescribed by regulations within the scope of Title IV of the Social Security Act, its amendments, and federal regulations and who does not have otherwise provided for him a subsistence compatible with decency and health. See Kentucky Statutes 205.010
  • Needy permanently and totally disabled: means a person eighteen (18) years of age or older and who has a permanent physical or mental impairment, disease, or loss that substantially precludes him from engaging in useful occupations within his competence and who is unable to provide for himself and who does not have otherwise provided for him a subsistence compatible with decency and health. See Kentucky Statutes 205.010
  • Neglect: means a situation in which an adult is unable to perform or obtain for himself or herself the goods or services that are necessary to maintain his or her health or welfare, or the deprivation of services by a caretaker that are necessary to maintain the health and welfare of an adult. See Kentucky Statutes 209.020
  • Nematode: means invertebrate animals of the phylum nemathelminthes and class nematoda, that is, unsegmented round worms with elongated, fusiform, or sac-like bodies covered with cuticle, and inhabiting soil, water, plants or plant parts. See Kentucky Statutes 217.544
  • New motor vehicle: means a vehicle that is in the possession of the manufacturer, distributor, or wholesaler, or has been sold to the holders of a valid sales and service agreement, franchise, or contract, granted by the manufacturer, distributor, or wholesaler for the sale of the make of new vehicle, which is new, and on which the original title has not been issued from the franchised dealer. See Kentucky Statutes 190.010
  • New motor vehicle dealer: means a vehicle dealer who holds a valid sales and service agreement, franchise, or contract, granted by the manufacturer, distributor, or wholesaler for the sale of the manufacturer's new motor vehicles. See Kentucky Statutes 190.010
  • New motor vehicle dealership facility: means an established place of business which is being used or will be used primarily for the purpose of selling, buying, displaying, repairing, and servicing motor vehicles. See Kentucky Statutes 190.010
  • New recreational vehicle: means a recreational vehicle that is in the possession of the manufacturer, distributor, or wholesaler, or has been sold to the holder of a valid dealer agreement, granted by the manufacturer, or distributor for the sale of the line-
    make of new recreational vehicle, and on which the original title has not been issued from the franchised dealer. See Kentucky Statutes 190A.010
  • New recreational vehicle dealer: means a recreational vehicle dealer who holds a valid dealer agreement, sales and service agreement, franchise, or contract granted by the manufacturer for the sale of the manufacturer's new recreational vehicles. See Kentucky Statutes 190A.010
  • New revenues: means :
    (a) The amount of local tax revenues received by a taxing district with respect to a development area in any calendar year beginning with the year in which the activation date occurred. See Kentucky Statutes 154.30-010
  • Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
  • Nonprofit motor vehicle dealer: means a nonprofit organization exempt from taxation under Section 501(c)(3) of the Internal Revenue Code that purchases motor vehicles that it may offer for purchase to clients and other individuals who meet the definition of client as defined in this section and who are referred to the organization by public or private social service agencies. See Kentucky Statutes 190.010
  • Nonresident: means every person who is not a resident of this state. See Kentucky Statutes 187.290
  • notes: means the bonds or bond anticipation notes authorized to be issued by the corporation under this chapter but shall not include any fund notes. See Kentucky Statutes 198A.010
  • nudist: means any person who displays any part of his private person naked before persons of the opposite sex, not his husband or wife, at their solicitation or with their consent, for religious or health purposes, excepting for purposes of examination and treatment by physicians. See Kentucky Statutes 232.010
  • Nurse: means a person authorized to practice professional nursing under the laws of the Commonwealth. See Kentucky Statutes 205.510
  • Nursing home: means a facility which provides routine medical care in which physicians regularly visit patients, which provide nursing services and procedures employed in caring for the sick which require training, judgment, technical knowledge, and skills beyond that which the untrained person possesses, and which maintains complete records on patient care, and which is licensed pursuant to the provisions of KRS §. See Kentucky Statutes 205.510
  • Obligations: means any bonds, bond anticipation notes, or fund notes authorized to be issued by the corporation under the provisions of this chapter. See Kentucky Statutes 198A.010
  • Obstructions: includes any object which prevents the easy, safe and convenient use of a county road for public travel. See Kentucky Statutes 179.010
  • Office: means the Office of Broadband Development. See Kentucky Statutes 224A.011
  • Office: means the Office for Children with Special Health Care Needs. See Kentucky Statutes 213.011
  • Old revenues: means :
    (a) The amount of local tax revenues received by a taxing district with respect to a development area as of December 31 of the year of preliminary approval. See Kentucky Statutes 154.30-010
  • Operator: means any person in actual control of a motor vehicle upon a highway. See Kentucky Statutes 186.010
  • Operator: means every person who is in actual physical control of a motor vehicle. See Kentucky Statutes 187.290
  • Operator: means the person in actual physical control of a vehicle. See Kentucky Statutes 189.010
  • Opiate: means any substance having an addiction-forming or addiction-sustaining liability similar to morphine or being capable of conversion into a drug having addiction-forming or addiction-sustaining liability. See Kentucky Statutes 218A.010
  • Opium poppy: means the plant of the species papaver somniferum L. See Kentucky Statutes 218A.010
  • Optometrist: means a person authorized to practice optometry under the laws of the Commonwealth. See Kentucky Statutes 205.510
  • Ordinary repair: means any nonstructural reconstruction or renewal of any part of an existing building for the purpose of its maintenance, or decoration, and shall include but not be limited to the replacement or installation of nonstructural components of the building such as roofing, siding, windows, storm windows, insulation, drywall or lath and plaster, or any other replacement, in kind, that does not alter the structural integrity, alter the occupancy or use of the building, or affect, by rearrangement, exitways and means of egress. See Kentucky Statutes 198B.010
  • Other drugs: means controlled substances as defined in KRS Chapter 218A and volatile substances as defined in KRS §. See Kentucky Statutes 222.005
  • Out-of-state registry identification card: means a registry identification card, or an equivalent document, that was issued pursuant to the laws of another state, district, territory, commonwealth, or insular possession of the United States. See Kentucky Statutes 218B.010
  • Outstanding: means increment bonds that have been issued, delivered, and paid for by the purchaser, except any of the following:
    (a) Increment bonds canceled upon surrender, exchange, or transfer, or upon payment or redemption. See Kentucky Statutes 154.30-010
  • Owner: means any person having any title or interest in lands, structures, rights-of-way, franchises, easements or other interests in land. See Kentucky Statutes 181.010
  • Owner: means a person who holds the legal title of a vehicle or a person who
    pursuant to a bona fide sale has received physical possession of the vehicle
    subject to any applicable security interest. See Kentucky Statutes 186.010
  • Owner: means a person who holds the legal title of a motor vehicle, or in the event
    a motor vehicle is the subject of an agreement for the conditional sale or lease
    thereof with the right of purchase upon performance of the conditions stated in the agreement and with an immediate right of possession vested in the conditional vendee or lessee or in the event a mortgagor of a vehicle is entitled to possession, then such conditional vendee or lessee or mortgagor shall be deemed the owner for the purposes of this chapter. See Kentucky Statutes 187.290
  • Paint horse: means a horse registered with the American Paint Horse Association of Fort Worth, Texas. See Kentucky Statutes 230.210
  • Patient: means any person admitted to a hospital or a licensed substance use disorder treatment program. See Kentucky Statutes 222.005
  • Pedestrian: means any person afoot or in a wheelchair. See Kentucky Statutes 189.010
  • Person: means any individual, firm, partnership, association, corporation, or governmental agency. See Kentucky Statutes 224A.011
  • Person: means an individual, partnership, corporation, association, or club. See Kentucky Statutes 229.011
  • Person: means any individual, partnership, association, or any organized group of persons whether incorporated or not. See Kentucky Statutes 217.544
  • Person: means a person, partnership, firm, corporation, association, trust, estate, or other legal entity. See Kentucky Statutes 190.010
  • Person: means individual, corporation, government or governmental subdivision or agency, business trust, estate, trust, partnership or association, or any other legal entity. See Kentucky Statutes 218A.010
  • Persons and families of lower and moderate income: shall include only those individuals whose family income combined does not exceed the income requirements defined under Section 143 of the Internal Revenue Code of 1986, as amended. See Kentucky Statutes 198A.010
  • Pest: means any insect, snail, slug, rodent, nematode, fungus, weed, and any other form of plant or animal life, or virus, bacteria, or other microorganism, except viruses, bacteria, or other microorganisms on or in living man or other living animals, which is normally considered to be a pest, or which the department may declare to be a pest. See Kentucky Statutes 217.544
  • Pesticide: means any substance or mixture of substances intended to prevent, destroy, control, repel, attract, or mitigate any pest. See Kentucky Statutes 217.544
  • Petitioner: means a person who institutes a proceeding under this chapter. See Kentucky Statutes 202A.011
  • Petitioner: means a person who institutes a proceeding under this chapter. See Kentucky Statutes 202B.010
  • Pharmacist: means a person authorized to practice pharmacy under the laws of the
    Commonwealth. See Kentucky Statutes 205.510
  • Pharmacist: means a natural person licensed by this state to engage in the practice
    of the profession of pharmacy. See Kentucky Statutes 218A.010
  • Physician: means a person authorized to practice medicine or osteopathy under the laws of the Commonwealth. See Kentucky Statutes 205.510
  • place of entertainment: means a roadhouse, place offering intoxicating or nonintoxicating drinks for sale, tourist camp or place of public entertainment at which people assemble to eat, drink, dance, bathe, or engage in any game or amusement, or any place having therein or thereon any person engaging in the practice of being a medium, clairvoyant, soothsayer, palmist, phrenologist, spiritualist, or like activity, or one who, with or without the use of cards, crystal ball, tea leaves, or any other object or device, engages in the practice of telling the fortune of another. See Kentucky Statutes 231.010
  • Placement services: means those social services customarily provided by a licensed child-placing or a public agency, which are necessary for the arrangement and placement of children in foster family homes, child-placing
    facilities, or adoptive homes. See Kentucky Statutes 199.011
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Plant regulator: means any substance or mixture of substances, intended through physiological actions, to accelerate or retard the rate of growth or maturation, or to otherwise alter the behavior of plants, but shall not include substances insofar as they are intended to be used as plant nutrients, trace elements, nutritional chemicals, plant inoculants, or soil amendments. See Kentucky Statutes 217.544
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
  • Podiatrist: means a person authorized to practice podiatry under the laws of the
    Commonwealth. See Kentucky Statutes 205.510
  • Poppy straw: means all parts, except the seeds, of the opium poppy, after mowing. See Kentucky Statutes 218A.010
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • Practitioner: means a physician, dentist, podiatrist, veterinarian, scientific investigator, optometrist as authorized in KRS §. See Kentucky Statutes 218A.010
  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Preliminary hearing: A hearing where the judge decides whether there is enough evidence to make the defendant have a trial.
  • Prescription: means a written, electronic, or oral order for a drug or medicine, or combination or mixture of drugs or medicines, or proprietary preparation, signed or given or authorized by a medical, dental, chiropody, veterinarian, optometric practitioner, or advanced practice registered nurse, and intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease in man or other animals. See Kentucky Statutes 218A.010
  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
  • Presumptive probation: means a sentence of probation not to exceed the maximum term specified for the offense, subject to conditions otherwise authorized by law, that is presumed to be the appropriate sentence for certain offenses designated in this chapter, notwithstanding contrary provisions of KRS Chapter 533. See Kentucky Statutes 218A.010
  • Principal: means any of the following individuals associated with a partnership, trust, association, limited liability company, or corporation that is licensed to conduct a horse race meeting or an applicant for a license to conduct a horse race meeting:
    (a) The chairman and all members of the board of directors of a corporation. See Kentucky Statutes 230.210
  • Prioritization schedules: means the list of wastewater treatment works, distribution facilities and water resources projects which the Energy and Environment Cabinet has evaluated and determined to be of priority for receiving financial assistance from the federally assisted wastewater revolving fund and the federally assisted
    drinking water revolving fund, or the list of infrastructure projects which the authority has evaluated and determined to be of priority for receiving financial aid from the infrastructure revolving fund. See Kentucky Statutes 224A.011
  • Private partner: means any entity that is a partner in a public-private partnership other than:
    (a) The Commonwealth of Kentucky. See Kentucky Statutes 175B.010
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Probate: Proving a will
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Probation officers: Screen applicants for pretrial release and monitor convicted offenders released under court supervision.
  • Processor: means an entity licensed as such under KRS §. See Kentucky Statutes 218B.010
  • Processor agent: means a principal officer, board member, employee, volunteer, or agent of a processor. See Kentucky Statutes 218B.010
  • Producer: means an entity licensed as such under KRS §. See Kentucky Statutes 218B.010
  • Producer agent: means a principal officer, board member, employee, volunteer, or agent of a producer. See Kentucky Statutes 218B.010
  • Production: includes the manufacture, planting, cultivation, growing, or harvesting of a controlled substance. See Kentucky Statutes 218A.010
  • Professional: means a physician, osteopathic physician, coroner, medical examiner, medical resident, medical intern, chiropractor, nurse, dentist, optometrist, emergency medical technician, paramedic, licensed mental health professional, therapist, cabinet employee, child-care personnel, teacher, school personnel, ordained minister or the denominational equivalent, victim advocate, or any organization or agency employing any of these professionals. See Kentucky Statutes 209A.020
  • Program: means a set of services rendered directly to the public that is organized around a common goal of either preventing, intervening, or treating substance use disorder problems. See Kentucky Statutes 222.005
  • Project: includes all bridges, tollhouses, garages, and other buildings and facilities which the authority deems necessary for the operation of the project, together with all property, rights, easements, and interests which may be acquired by the authority or by the Commonwealth for the construction and operation of a project. See Kentucky Statutes 175B.010
  • Project: means the design, right-of-way, utility, or construction phase of a highway construction project. See Kentucky Statutes 176.010
  • Project: means any property, asset, or improvement located in a development area and certified by the governing body as:
    (a) Being for a public purpose. See Kentucky Statutes 154.30-010
  • Project authority: means an authority created pursuant to KRS §. See Kentucky Statutes 175B.010
  • Project revenue bonds: means revenue funding bonds, revenue refunding bonds, notes, or other financial obligations issued under this chapter by the issuing authority. See Kentucky Statutes 175B.010
  • Project term: means the time for which an agreement shall be in effect. See Kentucky Statutes 154.31-010
  • Proof of financial responsibility: means proof of ability to respond in damages for liability, on account of accidents occurring subsequent to the effective date of said proof, arising out of the ownership, maintenance or use of a motor vehicle in
    amounts meeting the requirements of KRS §. See Kentucky Statutes 187.290
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Protective placement: means the transfer of an adult from his or her present living arrangement to another. See Kentucky Statutes 209.020
  • Protective services: means agency services undertaken with or on behalf of an adult in need of protective services who is being abused, neglected, or exploited. See Kentucky Statutes 209.020
  • provider: means any person or company certified by the Transportation Cabinet to engage in the business of manufacturing, selling, leasing, servicing, or monitoring ignition interlock devices within the Commonwealth. See Kentucky Statutes 189A.005
  • Psychiatric facility: means a crisis stabilization unit or any facility licensed by the cabinet and which provides inpatient, outpatient, psychosocial rehabilitation, emergency, and consultation and education services for the diagnosis and treatment of persons who have a mental illness. See Kentucky Statutes 202A.011
  • Public assistance: means money grants, assistance in kind, or services to or for the benefit of needy aged, needy blind, needy permanently and totally disabled persons, needy children, or persons with whom a needy child lives or a family containing a combination of these categories, except that the term shall not be construed to permit the granting of financial aid where the purpose of such aid is to obtain an abortion. See Kentucky Statutes 205.010
  • Public institution: means any establishment or place which is the responsibility of and administered by the state or any political subdivision thereof providing a group living arrangement in which one (1) or more individuals are cared for and
    maintained in residence. See Kentucky Statutes 205.010
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Public utility facilities: means tracks, pipes, mains, conduits, cables, wires, towers, poles, and other equipment and appliances of any public utility in, on, along, over, or under any project. See Kentucky Statutes 175B.010
  • Public-private partnership: means an entity operating pursuant to a written public-private partnership agreement, and composed of:
    (a) An authority or authorities. See Kentucky Statutes 175B.010
  • Qualified mental health professional: means :
    (a) A physician licensed under the laws of Kentucky to practice medicine or
    osteopathy, or a medical officer of the government of the United States while engaged in the performance of official duties. See Kentucky Statutes 202A.011
  • Qualified mental health professional: means :
    (a) A physician licensed under the laws of Kentucky to practice medicine or osteopathy, or a medical officer of the government of the United States while engaged in the performance of official duties. See Kentucky Statutes 202C.010
  • Qualified patient: means a person who has obtained a written certification from a medicinal cannabis practitioner with whom he or she has a bona fide practitioner- patient relationship. See Kentucky Statutes 218B.010
  • Qualified professional in the area of intellectual disabilities: means :
    (a) A physician licensed under the laws of Kentucky to practice medicine or osteopathy, or a medical officer of the government of the United States while engaged in the performance of official duties. See Kentucky Statutes 202B.010
  • Qualifying medical condition: means :
    (a) Any type or form of cancer regardless of stage. See Kentucky Statutes 218B.010
  • Qualifying offense: means a capital offense, a Class A felony, a Class B
    felony resulting in death or serious physical injury, or a violation of KRS
    510. See Kentucky Statutes 202C.010
  • Quarter horse: means a horse that is registered with the American Quarter Horse
    Association of Amarillo, Texas. See Kentucky Statutes 230.210
  • Racing commission: means the Kentucky Horse Racing Commission. See Kentucky Statutes 230.210
  • Rap back system: means a system that enables an authorized entity to receive ongoing status notifications of any criminal history from the Department of Kentucky State Police or the Federal Bureau of Investigation reported on an individual whose fingerprints are registered in the system, upon approval and implementation of the system. See Kentucky Statutes 199.011
  • Receiving track: means a track where simulcasts are displayed for wagering purposes. See Kentucky Statutes 230.210
  • Recipient: means any person who has received medical services provided by the Office for Children with Special Health Care Needs or who has received medical services paid for on his behalf by the office. See Kentucky Statutes 200.495
  • Records: means the medical, mental, health, and financial records of the adult that are in the possession of any hospital, firm, corporation, or other facility, if necessary to complete the investigation mandated in this chapter. See Kentucky Statutes 209.020
  • Recourse: An arrangement in which a bank retains, in form or in substance, any credit risk directly or indirectly associated with an asset it has sold (in accordance with generally accepted accounting principles) that exceeds a pro rata share of the bank's claim on the asset. If a bank has no claim on an asset it has sold, then the retention of any credit risk is recourse. Source: FDIC
  • Recovered material: means those materials which have known current use, reuse, or recycling potential, which can be feasibly used, reused, or recycled, and which have been diverted or removed from the solid waste stream for sale, use, reuse, or recycling, whether or not requiring subsequent separation and processing but does not include materials diverted or removed for purposes of energy recovery or combustion except refuse-derived fuel (RDF), which shall be credited as a recovered material in an amount equal to that percentage of the municipal solid waste received on a daily basis at the processing facility and processed into RDF. See Kentucky Statutes 224A.011
  • Recovered material processing facility: means a facility engaged solely in the storage, processing, and resale or reuse of recovered material but does not mean a solid waste facility if solid waste generated by a recovered material processing facility is managed in accordance with KRS Chapter 224 and administrative regulations adopted by the cabinet. See Kentucky Statutes 224A.011
  • Recovery program: means an evidence-based, nonclinical service that assists individuals and families working toward sustained recovery from substance use and other criminal risk factors. See Kentucky Statutes 218A.010
  • Recreational vehicle: means a vehicle that:
    (a) Is primarily designed as temporary living quarters for noncommercial recreation or camping use. See Kentucky Statutes 190.010
  • recreational vehicle: includes motor homes, travel trailers, fifth-wheel trailers, and folding camping trailers. See Kentucky Statutes 190A.010
  • Refusal: means declining to submit to any test or tests pursuant to KRS §. See Kentucky Statutes 189A.005
  • region: means the geographical area of Kentucky contained within the Appalachian region as defined by the federal Appalachian Regional Development Act of 1965, as amended. See Kentucky Statutes 154.33-510
  • Regional community services program: means a community services program for mental health or individuals with an intellectual disability established in accordance with this chapter, a community mental health center, a certified community behavioral health clinic, or a certified eligible community behavioral health clinic. See Kentucky Statutes 210.005
  • Registered mail: means any governmental, commercial, or electronic method of delivery that allows a document or package to have:
    (a) Its chain of custody recorded in a register to enable its location to be tracked. See Kentucky Statutes 446.010
  • Registrant: means a person who has registered any pesticide pursuant to the provisions of KRS §. See Kentucky Statutes 217.544
  • Registration: means registration certificates and registration plates issued under the laws of this state pertaining to the registration of motor vehicles. See Kentucky Statutes 187.290
  • Registration: means the acceptance by the Vital Statistics Branch and the incorporation of vital records provided for in this chapter into its official records. See Kentucky Statutes 213.011
  • Regular election: means the election in even-numbered years at which members of Congress are elected and the election in odd-numbered years at which state officers are elected. See Kentucky Statutes 446.010
  • Reinvestment project: means :
    (a) A reinvestment in the facility of an eligible company and in the full-time employees of an eligible company through the acquisition, construction, and installation of new equipment and, with respect thereto, the construction, rehabilitation, and installation of improvements to facilities necessary to house the new equipment, including surveys. See Kentucky Statutes 154.34-010
  • Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
  • Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
  • Research and development: means experimental or laboratory activity that has as its ultimate goal the development of new products, the improvement of existing products, the development of new uses for existing products, or the development or improvement of methods for producing products. See Kentucky Statutes 154.31-010
  • Resident: means a person under care or treatment in an ICF/ID pursuant to the provisions of this chapter. See Kentucky Statutes 202B.010
  • Resident: means any person who has established Kentucky as his or her state of domicile. See Kentucky Statutes 186.010
  • Residential housing: means a specific work or improvement undertaken primarily to provide dwelling accommodations for persons and families of lower and moderate income, including the acquisition, construction, or rehabilitation of land, buildings, and improvements, and other nonhousing facilities as may be incidental. See Kentucky Statutes 198A.010
  • Respondent: means a person alleged in a hearing under this chapter to be an individual with an intellectual disability. See Kentucky Statutes 202B.010
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Review hearing: means any hearing conducted to determine if a respondent continues to meet the criteria for involuntary commitment after the initial order for involuntary commitment has been issued under this chapter. See Kentucky Statutes 202C.010
  • Right of survivorship: The ownership rights that result in the acquisition of title to property by reason of having survived other co-owners.
  • Right-of-way: means the right of one (1) vehicle or pedestrian to proceed in a lawful manner in preference to another vehicle or pedestrian approaching under such circumstances of direction, speed, and proximity as to give rise to danger of collision unless one grants precedence to the other. See Kentucky Statutes 189.010
  • Roads: includes highways, bridges, and bridge approaches. See Kentucky Statutes 176.010
  • Roadway: means that portion of a highway improved, designed, or ordinarily used for vehicular travel, exclusive of the berm or shoulder. See Kentucky Statutes 189.010
  • Safety compliance facility: means an entity licensed as such under KRS §. See Kentucky Statutes 218B.010
  • Safety compliance facility agent: means a principal officer, board member, employee, volunteer, or agent of a safety compliance facility. See Kentucky Statutes 218B.010
  • Safety zone: means the area or space officially set apart within a roadway for the exclusive use of pedestrians and which is protected or is so marked or indicated by adequate signs as to be plainly visible at all times while set apart as a safety zone. See Kentucky Statutes 189.010
  • Sale: means the issuance, transfer, agreement for transfer, exchange, lease, pledge, hypothecation, mortgage in any form, whether by transfer in trust or otherwise, of any motor vehicle or interest in it, or of any franchise related to it, as well as any option, subscription, other contract, or solicitation looking to a sale, offer to attempt to sell in any form, whether spoken or written. See Kentucky Statutes 190.010
  • Salvia: means Salvia divinorum or Salvinorin A and includes all parts of the plant presently classified botanically as Salvia divinorum, whether growing or not, the seeds thereof, any extract from any part of that plant, and every compound, manufacture, derivative, mixture, or preparation of that plant, its seeds, or its extracts, including salts, isomers, and salts of isomers whenever the existence of
    such salts, isomers, and salts of isomers is possible within the specific chemical designation of that plant, its seeds, or extracts. See Kentucky Statutes 218A.010
  • Second or subsequent offense: means that for the purposes of this chapter an offense is considered as a second or subsequent offense, if, prior to his or her conviction of the offense, the offender has at any time been convicted under this chapter, or under any statute of the United States, or of any state relating to substances classified as controlled substances or counterfeit substances, except that a prior conviction for a nontrafficking offense shall be treated as a prior offense only when the subsequent offense is a nontrafficking offense. See Kentucky Statutes 218A.010
  • Secretary: means the secretary for health and family services. See Kentucky Statutes 199.011
  • Secretary: means the secretary of the Cabinet for Health and Family Services. See Kentucky Statutes 202A.011
  • Secretary: shall mean the secretary of the Cabinet for Health and Family Services. See Kentucky Statutes 202B.010
  • Secretary: means the secretary of the Cabinet for Health and Family Services. See Kentucky Statutes 202C.010
  • Secretary: means the secretary for health and family services or his authorized representative. See Kentucky Statutes 205.010
  • Secretary: means the secretary of the Transportation Cabinet. See Kentucky Statutes 183.010

  • Semitrailer: means a vehicle designed to be attached to, and having its front end supported by, a motor truck or truck tractor, intended for the carrying of freight or merchandise and having a load capacity of over one thousand (1,000) pounds. See Kentucky Statutes 189.010
  • Serious violation: means :
    (a) Any violation of this chapter or any administrative regulation promulgated
    thereunder that is capable of causing death or which causes serious and prolonged disfigurement, prolonged impairment of health, or prolonged loss or impairment of the function of any bodily organ. See Kentucky Statutes 218B.010
  • Service charge: means any monthly, quarterly, semiannual, or annual charge to be imposed by a governmental agency, or by the authority, for any infrastructure project financed by the authority, which service charge arises by reason of the existence of, and requirements of, any assistance agreement. See Kentucky Statutes 224A.011
  • service provider: means a person authorized to conduct or manage sports wagering through an agreement with a track and provide these services at a licensed facility for sports wagering, simulcast facility, or through a website or mobile interface approved by the racing commission. See Kentucky Statutes 230.210
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Sewage: means any of the waste products or excrements, or other discharges from the bodies of human beings or animals, which pollute the waters of the state. See Kentucky Statutes 224A.011
  • Sexual offender: means any person convicted of, pleading guilty to, or entering an
    Alford plea to a sex crime as defined in KRS §. See Kentucky Statutes 197.010
  • Shapefile: means a file format for storing, depicting, and analyzing geospatial data showing broadband coverage. See Kentucky Statutes 224A.011
  • Show: means any boxing, kickboxing, mixed martial arts, muay thai, or wrestling match, contest, or exhibition coming under the jurisdiction of the Kentucky Boxing and Wrestling Commission. See Kentucky Statutes 229.011
  • Signature project: means a project approved under KRS §. See Kentucky Statutes 154.30-010
  • Simulcast facility: means any facility approved pursuant to the provisions of KRS
    230. See Kentucky Statutes 230.210
  • Simulcasting: means the telecast of live audio and visual signals of horse races for
    the purpose of pari-mutuel wagering. See Kentucky Statutes 230.210
  • Smoking: means the inhalation of smoke produced from the combustion of raw plant material when ignited by a flame. See Kentucky Statutes 218B.010
  • Solid waste: means "solid waste" as defined by KRS §. See Kentucky Statutes 224A.011
  • Solid waste facility: means any facility for collection, handling, storage, transportation, transfer, processing, treatment, or disposal of solid waste, whether the facility is associated with facilities generating the waste or otherwise, but does not include a container located on property where the waste is generated and which is used solely for the purpose of collection and temporary storage of that solid waste prior to off-site disposal, or a recovered material processing facility. See Kentucky Statutes 224A.011
  • Special status individual: means :
    (a) "Asylee" means any person lawfully present in the United States who possesses an I-94 card issued by the United States Department of Justice, Immigration and Naturalization Service, on which it states "asylum status granted indefinitely pursuant to Section 208 of the Immigration & Nationality Act". See Kentucky Statutes 186.010
  • Sporting event: means an event at which two (2) or more persons participate in athletic contests, or an event that takes place in relation to athletic contests as approved by the racing commission but shall not include horse racing or amateur youth sports or athletic events in which the majority of participants are under the age of eighteen (18). See Kentucky Statutes 230.210
  • Sports wagering: means the wagering conducted under this chapter on sporting events or portions of sporting events, or on the individual performance statistics of athletes in a sporting event or combination of sporting events, in conformance with federal law and as authorized by the racing commission pursuant to this chapter. See Kentucky Statutes 230.210
  • Spray adjuvant: means any wetting agent, spreading agent, sticker, deposit builder, adhesive, emulsifying agent, deflocculating agent, water modifier, or similar agent intended to be used with any other pesticide as an aid to the application or to the effect thereof, and which is in a package or container separate from that of the other pesticide with which it is to be used. See Kentucky Statutes 217.544
  • State: means the Commonwealth of Kentucky. See Kentucky Statutes 224A.011
  • State: means any state, territory or possession of the United States, the District of
    Columbia, or any province of the Dominion of Canada. See Kentucky Statutes 187.290
  • State agency: means any department, board, commission, or agency of the state government. See Kentucky Statutes 197.010
  • State authority: means the Kentucky Public Transportation Infrastructure
    Authority created under KRS §. See Kentucky Statutes 175B.010
  • State licensing board: means :
    (a) The Kentucky Board of Medical Licensure. See Kentucky Statutes 218B.010
  • State Police: includes any agency for the enforcement of the highway laws established pursuant to law. See Kentucky Statutes 189.010
  • State real property ad valorem tax: means real property ad valorem taxes levied under KRS §. See Kentucky Statutes 154.30-010
  • State tax revenues: means revenues received by the Commonwealth from one (1)
    or more of the following sources:
    (a) State real property ad valorem taxes. See Kentucky Statutes 154.30-010
  • Story: means that part of a building comprised between a floor and the floor or roof next above which is not a basement or an attic. See Kentucky Statutes 198B.010
  • Streets: includes lanes and alleys. See Kentucky Statutes 181.010
  • Substance use disorder: means a cluster of cognitive, behavioral, and physiological symptoms indicating that the individual continues using the substance despite significant substance-related problems. See Kentucky Statutes 222.005
  • Sudden infant death syndrome: means the death of an ostensibly healthy child who is two (2) weeks of age or older but less than three (3) years of age, which occurs suddenly and unexpectedly, with no known or apparent cause, and which remains unexplained after the performance of an autopsy. See Kentucky Statutes 213.011
  • Summons: Another word for subpoena used by the criminal justice system.
  • Sunscreening material: means a product or material, including film, glazing, and perforated sunscreening, which, when applied to the windshield or windows of a motor vehicle, reduces the effects of the sun with respect to light reflectance or transmittance. See Kentucky Statutes 189.010
  • Supplier: means any person, firm, corporation, or business entity that engages in the manufacturing of recreational vehicle parts, accessories, or components. See Kentucky Statutes 190A.010
  • Sworn: includes "affirmed" in all cases in which an affirmation may be substituted for an oath. See Kentucky Statutes 446.010
  • Synthetic cannabinoids or piperazines: means any chemical compound which is not approved by the United States Food and Drug Administration or, if approved, which is not dispensed or possessed in accordance with state and federal law, that contains Benzylpiperazine (BZP). See Kentucky Statutes 218A.010
  • Synthetic cathinones: means any chemical compound which is not approved by the United States Food and Drug Administration or, if approved, which is not dispensed or possessed in accordance with state and federal law (not including bupropion or compounds listed under a different schedule) structurally derived from
    2-aminopropan-1-one by substitution at the 1-position with either phenyl, naphthyl, or thiophene ring systems, whether or not the compound is further modified in one (1) or more of the following ways:
    (a) By substitution in the ring system to any extent with alkyl, alkylenedioxy, alkoxy, haloalkyl, hydroxyl, or halide substituents, whether or not further substituted in the ring system by one (1) or more other univalent substituents. See Kentucky Statutes 218A.010
  • Synthetic drugs: means any synthetic cannabinoids or piperazines or any synthetic cathinones. See Kentucky Statutes 218A.010
  • System: means the system owned and operated by a governmental agency with respect to solid waste projects, treatment works, or infrastructure projects financed as provided by the assistance agreement between the governmental agency and the authority. See Kentucky Statutes 224A.011
  • System of vital statistics: means the registration, collection, preservation, amendment, and certification of vital records and the collection of other reports required by this chapter. See Kentucky Statutes 213.011
  • Tax incentive agreement: means an agreement entered into in accordance with
    KRS §. See Kentucky Statutes 154.30-010
  • Telehealth: means the same as in KRS §. See Kentucky Statutes 205.510
  • Telehealth consultation: means a medical or health consultation, for purposes of patient diagnosis or treatment, that meets the definition of telehealth in this section. See Kentucky Statutes 205.510
  • Telephone account wagering: means a form of pari-mutuel wagering where an individual may deposit money in an account at a track and may place a wager by direct telephone call or by communication through other electronic media owned by
    the holder of the account to the track. See Kentucky Statutes 230.210
  • Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
  • Termination date: means :
    (a) For a tax incentive agreement satisfying the requirements of KRS §. See Kentucky Statutes 154.30-010
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Third-party coverage: means any public or private party who is liable to provide medical services or to make medical services benefit payments to a recipient or other provider for medical services provided to a recipient under the terms of any contract, health insurance policy, health insurance plan, settlement, or award. See Kentucky Statutes 200.495
  • this state: means the Commonwealth of Kentucky. See Kentucky Statutes 183.012
  • Thoroughbred racing: means a form of horse racing in which each horse participating in the race is a Thoroughbred, (i. See Kentucky Statutes 230.210
  • Trailer: means any vehicle designed to be drawn by a motor truck or truck-tractor, but supported wholly upon its own wheels, intended for the carriage of freight or merchandise and having a load capacity of over one thousand (1,000) pounds. See Kentucky Statutes 189.010
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Transfer: means to dispose of a controlled substance to another person without consideration and not in furtherance of commercial distribution. See Kentucky Statutes 218A.010
  • Transient customer: means a person who is temporarily traveling through the area of sales responsibility of a recreational vehicle dealer. See Kentucky Statutes 190A.010
  • Transmittance: means the ratio of the amount of total light, expressed in a percentage, which is allowed to pass through the product or material, including glazing, to the amount of total light falling on the product or material and the glazing. See Kentucky Statutes 189.010
  • Treatment: includes those services provided by the cabinet in KRS §. See Kentucky Statutes 222.005
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Truck tractor: means any motor-propelled vehicle designed to draw and to support the front end of a semitrailer. See Kentucky Statutes 189.010
  • Truth in Lending Act: The Truth in Lending Act is a federal law that requires lenders to provide standardized information so that borrowers can compare loan terms. In general, lenders must provide information on Source: OCC
  • Ultimate user: means a person who lawfully possesses a controlled substance for his or her own use or for the use of a member of his or her household or for administering to an animal owned by him or her or by a member of his or her household. See Kentucky Statutes 218A.010
  • Unarmed combat: means boxing, kickboxing, sparring, wrestling, mixed martial arts, or muay thai under the jurisdiction of the commission. See Kentucky Statutes 229.011
  • Unreasonable adverse effects on the environment: means any unreasonable risk to man or the environment, taking into account the economic, social, and environmental costs and benefits of the use of any pesticide. See Kentucky Statutes 217.544
  • Unserved area: means any project area where broadband service with a minimum twenty-five (25) megabits per second downstream and three (3) megabits per second upstream is not available. See Kentucky Statutes 224A.011
  • Uphold: The decision of an appellate court not to reverse a lower court decision.
  • User fees: Fees charged to users of goods or services provided by the government. In levying or authorizing these fees, the legislature determines whether the revenue should go into the treasury or should be available to the agency providing the goods or services.
  • validated risk and needs assessment: means an actuarial tool scientifically proven to determine a person's risk to reoffend and criminal risk factors, that when properly addressed, can reduce that person's likelihood of committing future criminal behavior. See Kentucky Statutes 446.010
  • Variable rate revenue bonds: means revenue bonds the rate of interest on which fluctuates either automatically by reference to a predetermined formula or index or in accordance with the standards set forth in KRS §. See Kentucky Statutes 224A.011
  • vehicle: means every device in, upon, or by which any person or property is or may be transported or drawn upon a public highway, except electric low-speed scooters, devices moved by human and animal power or used exclusively upon stationary rails or tracks, or which derives its power from overhead wires. See Kentucky Statutes 186.010
  • Vehicle: includes :

  • Venue: The geographical location in which a case is tried.
  • Victim: means an individual who is or has been abused by a spouse or former spouse or an intimate partner who meets the definition of a member of an unmarried couple as defined in KRS §. See Kentucky Statutes 209A.020
  • Victim advocate: work with prosecutors and assist the victims of a crime.
  • Violate: includes failure to comply with. See Kentucky Statutes 446.010
  • Visiting qualified patient: means a person who has registered as such through the cabinet as required under this chapter or who possesses a valid out-of-state registry identification card and documentation of having been diagnosed with a qualifying medical condition. See Kentucky Statutes 218B.010
  • Vital records: means certificates or reports of birth, death, stillbirth, marriage,
    dissolution of marriage, or annulment, and data related thereto. See Kentucky Statutes 213.011
  • Vital statistics: means the data derived from certificates and reports of birth, death, stillbirth, abortion, marriage, dissolution of marriage, and related reports. See Kentucky Statutes 213.011
  • Voluntary and informed consent: means that at the time of the execution of the consent, the consenting person was fully informed of the legal effect of the consent, that the consenting person was not given or promised anything of value except those expenses allowable under KRS §. See Kentucky Statutes 199.011
  • Warrantor: means any person, firm, corporation, or business entity, including any manufacturer or supplier, which provides a written warranty to the consumer in connection with a new recreational vehicle or parts, accessories, or components thereof. See Kentucky Statutes 190A.010
  • Wastewater: means any water or liquid substance containing sewage, industrial waste, or other pollutants or contaminants derived from the prior use of these waters. See Kentucky Statutes 224A.011
  • wastewater treatment works: means all or any part of any facilities, devices, and systems used and useful in the storage, treatment, recycling, and reclamation of wastewater or the abatement of pollution, including facilities for the treatment, neutralization, disposal of, stabilization, collecting, segregating, or holding of wastewater, including without limiting the generality of the foregoing, intercepting sewers, outfall sewers, pumping power stations, and other equipment and their appurtenances. See Kentucky Statutes 224A.011
  • Water resources: means all waters of the state occurring on the surface, in natural or artificial channels, lakes, reservoirs, or impoundments, and in subsurface aquifers, which are available, or which may be made available to agricultural, industrial, commercial, recreational, public, and domestic users. See Kentucky Statutes 224A.011
  • Waters of the state: means all streams, lakes, watercourses, waterways, ponds,
    marshes, wells, springs, irrigation systems, drainage systems, and all other bodies or accumulations of water, surface and underground, natural or artificial, which are situated wholly or partly within, or border upon, this state, or are within its jurisdiction, except those private waters which do not combine or effect a junction with natural, surface, or underground waters. See Kentucky Statutes 224A.011
  • Weed: means any plant which grows where not wanted. See Kentucky Statutes 217.544
  • Wildlife: means all living things that are neither human, domesticated, nor as defined in KRS §. See Kentucky Statutes 217.544
  • Window: means any device designed for exterior viewing from a motor vehicle, except the windshield, any roof-mounted viewing device, and any viewing device having less than one hundred fifty (150) square inches in area. See Kentucky Statutes 189.010
  • Workplace: means any property that is owned or leased by the health facility at which the official business of the health care worker is conducted. See Kentucky Statutes 216.701
  • Workplace safety: means the process of protecting health care workers' physical well-being from workplace violence. See Kentucky Statutes 216.701
  • Workplace violence: means any act or threat of physical violence, harassment, intimidation, or other threatening disruptive behavior that occurs at the workplace. See Kentucky Statutes 216.701
  • Wrecker: shall mean a motor vehicle on which a wrecking crane and other equipment suitable for motor vehicle wrecker service has been permanently mounted. See Kentucky Statutes 189.011
  • Wrestling: means an activity or performance of athletic and wrestling skill between individuals who are not under the jurisdiction of the Kentucky High School Athletic Association, the National Collegiate Athletic Association, the National Association of Intercollegiate Athletics, or USA Wrestling in which the participants struggle hand-to-hand primarily for the purpose of providing
    entertainment to spectators rather than conducting a bona fide athletic contest. See Kentucky Statutes 229.011
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
  • Written certification: means a document dated and signed by a medicinal cannabis practitioner, that:
    (a) States, that in the medicinal cannabis practitioner's professional medical opinion, the patient may receive medical, therapeutic, or palliative benefit from the use of medicinal cannabis. See Kentucky Statutes 218B.010
