Terms Used In Louisiana Revised Statutes 13:3382

  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.

            A. Notwithstanding any provision of law to the contrary, a plaintiff filing a claim for defamation of character, libel, slander, or damage to reputation referenced in La. Rev. Stat. 13:3381, waives all privileges and protections relating to the civil or criminal investigations, administrative hearings, or any other hearing or legal proceeding regarding the alleged sexual misconduct.

            B. Such waiver shall apply but not be limited to all evidence, records, testimony, and findings of an investigation, hearing, or proceeding.

            C. Such waiver shall not be construed to waive the attorney-client privilege of any party.
