Terms Used In Louisiana Revised Statutes 40:75

  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • person: includes a body of persons, whether incorporated or not. See Louisiana Revised Statutes 1:10
  • Vital records registry: means a central registry as provided for in La. See Louisiana Revised Statutes 40:32

            A. Adult adoptions and name changes resulting from the adoptions pursuant to La. Rev. Stat. 9:465 shall have no effect on birth certificates maintained by the vital records registry, except that when a name change is effected pursuant to La. Rev. Stat. 9:465 and an affidavit is presented from the district attorney of the parish or place of residence of the requesting party indicating that there is no objection of the district attorney to the adoptee’s name change along with a certified copy of the notarial act of adoption and the appropriate fee, the registrar of vital records shall prepare a new birth certificate to reflect the new name. If there is an objection from the district attorney, the registrar of vital records shall not seal the adopted person‘s birth certificate nor prepare a new certificate until the grounds for the objection have been removed and confirmed by a supplemental affidavit from the district attorney.

            B. In such cases, the validity and civil effects of the notarial act of adoption are in no way affected and shall continue to be governed by the laws applicable thereto.
