Terms Used In Louisiana Revised Statutes 45:164.1

  • Commission: means the Louisiana Public Service Commission. See Louisiana Revised Statutes 45:162
  • Household goods: means :

                (a) Personal effects and property used or to be used in a dwelling when the personal effects and property are a part of the equipment or supply of such dwelling. See Louisiana Revised Statutes 45:162

  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Motor carriers: include both a common carrier by motor vehicle and contract carrier by motor vehicle, which transport household goods, passengers, waste intrastate, or any other classification of carriers created by law which transports household goods, passengers, or waste intrastate for compensation or hire. See Louisiana Revised Statutes 45:162

A.  The attorney general may receive information and documents and may receive and otherwise investigate complaints with respect to the commercial and trade practices of, or acts of, motor carriers transporting household goods for consumers in violation of La. Rev. Stat. 45:164, including any regulations of this state or its agencies adopted hereunder.  The attorney general may institute legal proceedings seeking injunctive relief, fines, or other relief and take such other actions provided for herein or which are necessary or incidental to the exercise of his powers and functions.  All costs incurred by the state in connection with such legal proceedings shall be borne by the carrier if found to be in violation of La. Rev. Stat. 45:164 or rules and regulations adopted pursuant thereto.

B.  Nothing in this Section is intended to be nor shall be construed to constitute any limitation, derogation, or diminution of the jurisdiction or authority of the Louisiana Public Service Commission over motor carriers transporting household goods.
