§ 40:2120.11 This Part shall be known and may be cited as the “Nurse Staffing Agency Licensing Law”.
§ 40:2120.12 The purpose of this Part is to authorize the Louisiana Department of Health to promulgate and publish rules and regulations to provide for the licensure of nurse staffing agencies.
§ 40:2120.13 As used in this Part, the following terms have the meanings ascribed to them in this Section:

§ 40:2120.19 The department may, after appropriate notice and hearing, suspend, revoke, or refuse to issue or renew any license if the licensee or applicant fails to comply with this Part or the
§ 40:2120.20 A. The department, by rule, shall establish minimum standards for the operation of nurse staffing agencies. Those standards shall include but are not limited to the following:
§ 40:2120.21 A. The department may at any time, upon receiving a complaint from any interested person regarding allegations that a nurse staffing agency is operating without a valid license issue

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Certified nurse aide: means an individual who has completed a Nurse Aide Training and Competency Evaluation Program approved by the state as meeting the requirements of 42 C. See Louisiana Revised Statutes 40:2120.13
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Department: means the Louisiana Department of Health or any office or agency thereof designated by the secretary of the department to administer the provisions of this Part. See Louisiana Revised Statutes 40:2120.13
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Healthcare facility: means any person, partnership, corporation, unincorporated association, or other legal entity licensed pursuant to La. See Louisiana Revised Statutes 40:2120.13
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Licensee: means any nursing agency properly licensed in accordance with this Part. See Louisiana Revised Statutes 40:2120.13
  • Nurse: means a registered nurse as defined in La. See Louisiana Revised Statutes 40:2120.13
  • Nurse staffing agency: means any person, partnership, corporation, unincorporated association, or other legal entity that employs, assigns, or refers nurses or certified nurse aides to render healthcare services in a healthcare facility for a fee. See Louisiana Revised Statutes 40:2120.13
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • person: includes a body of persons, whether incorporated or not. See Louisiana Revised Statutes 1:10
  • Secretary: means the secretary of the Louisiana Department of Health or his designee. See Louisiana Revised Statutes 40:2120.13
