Terms Used In Maine Revised Statutes > Title 15 > Part 6 > Chapter 503 - Jurisdiction

  • Adjudication: means a finding by a court that a person has committed a traffic infraction and includes the acceptance by the clerk of the violations bureau or any judicial division of an answer of not contested. See Maine Revised Statutes Title 29-A Sec. 101
  • Adjudicatory hearing: means a hearing to determine whether the allegations of a petition under chapter 507 are supported by evidence that satisfies the standard of proof required. See Maine Revised Statutes Title 15 Sec. 3003
  • Adult: means a person 18 years of age or over. See Maine Revised Statutes Title 15 Sec. 3003
  • Bicycle: means a vehicle primarily propelled by human power, operated by a person usually seated on a seat and driven on the ground on wheels by the operator. See Maine Revised Statutes Title 29-A Sec. 2322
  • Bicycle helmet: means a piece of protective headgear intended for bicyclists that meets or exceeds the Consumer Products Safety Commission's standards. See Maine Revised Statutes Title 29-A Sec. 2322
  • Bicycle passenger: means any person who is traveling on a bicycle, a bicycle trailer or a similar product but is not an operator. See Maine Revised Statutes Title 29-A Sec. 2322
  • Bicycle passenger seat: means a seat separate from the saddle or seat for the operator of the bicycle or bicycle trailer or similar product that is securely fastened to the frame of the bicycle and is specifically designed for bicycle passenger use. See Maine Revised Statutes Title 29-A Sec. 2322
  • Bicycle taxi: means a bicycle designed to carry passengers. See Maine Revised Statutes Title 29-A Sec. 2322
  • Bicycle taxi passenger: means a person who is traveling on a bicycle taxi but is not the operator of the bicycle taxi. See Maine Revised Statutes Title 29-A Sec. 2322
  • Bikeway: means a vehicle way, paved or unpaved, upon which bicycles, unicycles or other vehicles propelled by human power may be pedaled. See Maine Revised Statutes Title 29-A Sec. 2322
  • Bind-over hearing: means a hearing at which the Juvenile Court determines whether to permit the State to proceed against a juvenile as if the juvenile were an adult. See Maine Revised Statutes Title 15 Sec. 3003
  • Bureau: means the Bureau of Motor Vehicles. See Maine Revised Statutes Title 29-A Sec. 101
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Department: means the Department of Transportation. See Maine Revised Statutes Title 29-A Sec. 101
  • Detention: means the holding of a person in a facility characterized by either physically restrictive construction or intensive staff supervision that is intended to prevent a person who is placed in or admitted to the facility from departing at will.   • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • Emancipation: means the release of a juvenile from the legal control of the juvenile's parents. See Maine Revised Statutes Title 15 Sec. 3003
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Facility: means any physical structure. See Maine Revised Statutes Title 15 Sec. 3003
  • Grand jury: agreement providing that a lender will delay exercising its rights (in the case of a mortgage,
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Guardian: means a person lawfully invested with the power, and charged with the duty, of taking care of a person and managing the property and rights of the person, who, because of age, is considered incapable of administering the person's own affairs.   • highway: means a public way. See Maine Revised Statutes Title 29-A Sec. 101
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Juvenile: means a person who had not attained 18 years of age at the time the person allegedly committed a juvenile crime. See Maine Revised Statutes Title 15 Sec. 3003
  • Juvenile Court: means the District Court exercising the jurisdiction conferred by section 3101. See Maine Revised Statutes Title 15 Sec. 3003
  • Juvenile crime: has the meaning set forth in section 3103. See Maine Revised Statutes Title 15 Sec. 3003
  • Legal custodian: means a person who has legal custody of a juvenile. See Maine Revised Statutes Title 15 Sec. 3003
  • License: includes , but is not limited to, a nonresident operating privilege and the privilege of a person to apply for or obtain a license or permit to operate a motor vehicle. See Maine Revised Statutes Title 29-A Sec. 101
  • Motor vehicle: means a self-propelled vehicle not operated exclusively on railroad tracks, but does not include:

  • Operator: means a person who travels on and controls a bicycle or roller skis. See Maine Revised Statutes Title 29-A Sec. 2322
  • Parent: means either a natural parent or the adoptive parent of a juvenile. See Maine Revised Statutes Title 15 Sec. 3003
  • Person: means an individual, corporation, firm, partnership, joint venture, association, fiduciary, trust, estate or any other legal or commercial entity. See Maine Revised Statutes Title 29-A Sec. 101
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Public roadway: means a right-of-way under the jurisdiction and control of the State or a local political subdivision of the State for the use primarily by motor vehicular traffic. See Maine Revised Statutes Title 29-A Sec. 2322
  • Registration: means the registration certificate, plates and renewal devices pertaining to the registration of a vehicle, including temporary registered gross weight increases. See Maine Revised Statutes Title 29-A Sec. 101
  • Statute: A law passed by a legislature.
  • Traffic: means pedestrians, ridden or herded animals, vehicles, bicycles and other conveyances either singly or together using public way for travel. See Maine Revised Statutes Title 29-A Sec. 101
  • Trailer: means a vehicle without motive power, designed to carry persons or property and to be drawn by a motor vehicle, not operated on railroad tracks, and so constructed that no part of its weight rests upon the towing vehicle. See Maine Revised Statutes Title 29-A Sec. 101
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Vehicle: means a device for conveyance of persons or property on a way. See Maine Revised Statutes Title 29-A Sec. 101
  • Way: means the entire width between boundary lines of a road, highway, parkway, street or bridge used for vehicular traffic, whether public or private. See Maine Revised Statutes Title 29-A Sec. 101
  • Year: means a calendar year, unless otherwise expressed. See Maine Revised Statutes Title 1 Sec. 72
