A person who has been convicted of a crime of which the decedent was a victim is not entitled to the following benefits to the extent that the benefits do not exceed the amount of restitution the person owes to the decedent as a result of the sentence for the crime: [PL 2017, c. 402, Pt. 1. Decedent‘s will or this Article. Any benefits under the decedent’s will or under this Article;

Terms Used In Maine Revised Statutes Title 18-C Sec. 2-803

  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Decedent: A deceased person.
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
2. Jointly owned property. Any property owned jointly with the decedent;

3. Bond, life insurance policy or other contractual arrangement. Any benefit as a beneficiary of a bond, life insurance policy or other contractual arrangement in which the principal obligee or the person upon whose life the policy is issued is the decedent; and

4. Acquisition of property. Any benefit from any acquisition of property in which the decedent had an interest.
