An adult with long-term care needs is eligible for in-home and community support services under this chapter if the department or its designee determines that the adult: [PL 1981, c. 511, §1 (NEW).]
1. Inappropriate placement. Is at risk of being or already has been placed inappropriately in an institutional setting;

Terms Used In Maine Revised Statutes Title 22 Sec. 7322
- Adult: means a person who has attained the age of 18 years. See Maine Revised Statutes Title 1 Sec. 72
- Department: means the Department of Health and Human Services. See Maine Revised Statutes Title 22 Sec. 7302
- In-home and community support services: means health and social services and other assistance required to enable adults with long-term care needs to remain in their places of residence. See Maine Revised Statutes Title 22 Sec. 7302
2. Need for services. Has a need for in-home and community support services; and

3. Income and support. Has no or insufficient personal income or other support from public services, family members and neighbors.
