A person who violates section 2323, subsection 1 commits a traffic infraction. [PL 2013, c. 482, §5 (AMD).]
1. Education. For a first violation of section 2323, subsection 1, a law enforcement officer may provide safety information to the person. The officer may also inform that person’s parent or guardian about the provisions of this chapter and about where to obtain an appropriate helmet.

Terms Used In Maine Revised Statutes Title 29-A Sec. 2326

  • Bicycle: means a vehicle primarily propelled by human power, operated by a person usually seated on a seat and driven on the ground on wheels by the operator. See Maine Revised Statutes Title 29-A Sec. 2322
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Law enforcement officer: means a person who by virtue of public employment is vested by law with a duty to maintain public order or to make arrests for crimes, whether that duty extends to all crimes or is limited to specific crimes. See Maine Revised Statutes Title 29-A Sec. 101
  • Person: means an individual, corporation, firm, partnership, joint venture, association, fiduciary, trust, estate or any other legal or commercial entity. See Maine Revised Statutes Title 29-A Sec. 101
  • Traffic: means pedestrians, ridden or herded animals, vehicles, bicycles and other conveyances either singly or together using public way for travel. See Maine Revised Statutes Title 29-A Sec. 101
2. Forfeiture. For a 2nd or subsequent violation of section 2323, subsection 1, a forfeiture of no more than $25 may be adjudged. The fine may be waived if a person presents proof of purchase of a bicycle helmet since the citation.
