Terms Used In Maine Revised Statutes > Title 32 > Chapter 71-A - Maine Veterinary Practice Act of 1975

  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Animal: means any animal other than man and includes fowl, birds, fish and reptiles, wild or domestic, living or dead. See Maine Revised Statutes Title 32 Sec. 4853
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Autocycle: means a 3-wheeled motorcycle that has a steering wheel or handlebars, floor pedals for automotive-style controls and seating that does not require the operator to straddle or sit astride a seat and that:

  • Automobile: means a motor vehicle designed for the conveyance of passengers that has a seating capacity of not more than 15 persons, including the operator. See Maine Revised Statutes Title 29-A Sec. 101
  • Board: means the State Board of Veterinary Medicine. See Maine Revised Statutes Title 32 Sec. 4853
  • Bureau: means the Bureau of Motor Vehicles. See Maine Revised Statutes Title 29-A Sec. 101
  • Bus: means a motor vehicle designed for carrying more than 15 persons, including the operator. See Maine Revised Statutes Title 29-A Sec. 101
  • Camp trailer: includes a manufactured or homemade tent trailer, so called, that consists of a platform, shelf or box with means of permanently or temporarily attaching a tent. See Maine Revised Statutes Title 29-A Sec. 101
  • Commissioner: means the Commissioner of Professional and Financial Regulation. See Maine Revised Statutes Title 32 Sec. 4853
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Daytime: means any time from 1/2 hour before sunrise to 1/2 hour after sunset. See Maine Revised Statutes Title 29-A Sec. 101
  • Department: means the Department of Transportation. See Maine Revised Statutes Title 29-A Sec. 101
  • Direct supervision: means any time when a supervisor is on the premises and is quickly and easily available. See Maine Revised Statutes Title 32 Sec. 4853
  • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • Farming: means engaging in farming in all its branches and the cultivation and tillage of the soil as a livelihood and includes dairying; raising livestock, equines not raised for racing at a commercial track, freshwater fish, fur-bearing animals or poultry; producing, cultivating, growing and harvesting fruit, produce or floricultural or horticultural commodities; or any practices on a farm that are incident to or in conjunction with these farming operations.   • Fiduciary: A trustee, executor, or administrator.
  • Fraud: Intentional deception resulting in injury to another.
  • Golf cart: means a motor vehicle that is originally designed and manufactured for operation on a golf course for sporting or recreational purposes and that is not capable of exceeding speeds of 20 miles per hour. See Maine Revised Statutes Title 29-A Sec. 101
  • Gross weight: means the weight in pounds of an empty vehicle or axle plus the weight of the maximum load to be carried by the vehicle or axle. See Maine Revised Statutes Title 29-A Sec. 101
  • highway: means a public way. See Maine Revised Statutes Title 29-A Sec. 101
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • Indirect supervision: means any time when a supervisor is not on the premises but is available for consultation on patient care. See Maine Revised Statutes Title 32 Sec. 4853
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Intersection: means :

  • lands: includes lands and all tenements and hereditaments connected therewith, and all rights thereto and interests therein. See Maine Revised Statutes Title 1 Sec. 72
  • License: includes , but is not limited to, a nonresident operating privilege and the privilege of a person to apply for or obtain a license or permit to operate a motor vehicle. See Maine Revised Statutes Title 29-A Sec. 101
  • Licensed veterinarian: means a person who is validly and currently licensed by the board to practice veterinary medicine in this State. See Maine Revised Statutes Title 32 Sec. 4853
  • Licensed veterinary technician: means a person who has completed a minimum of 2 years in a college program that is certified according to the standards adopted by the American Veterinary Medical Association's Committee on Veterinary Technician Education and Activities or an equivalent program, as determined by the board, and who has passed an examination for licensure prescribed by the board. See Maine Revised Statutes Title 32 Sec. 4853
  • Low-speed vehicle: means a 4-wheeled motor vehicle that is able to attain a speed of at least 20 miles per hour but not more than 25 miles per hour and is less than 3,000 pounds in unloaded weight. See Maine Revised Statutes Title 29-A Sec. 101
  • Majority: when used in reference to age shall mean the age of 18 and over. See Maine Revised Statutes Title 1 Sec. 72
  • Minor: means a person who has not attained 18 years of age. See Maine Revised Statutes Title 29-A Sec. 101
  • Month: means a calendar month. See Maine Revised Statutes Title 1 Sec. 72
  • Moped: means a motorized device designed to travel with only 2 or 3 10-inch or larger diameter wheels in contact with the ground and that:

  • Motor vehicle: means a self-propelled vehicle not operated exclusively on railroad tracks, but does not include:

  • Motorcycle: means a motor vehicle that has a seat or a saddle for the use of the rider and is designed to travel with only 2 or 3 10-inch or larger diameter wheels in ground contact and has a motor with a cylinder capacity of more than 50 cubic centimeters or an electric motor with a capacity of not less than 1,500 watts. See Maine Revised Statutes Title 29-A Sec. 101
  • Nonresident: means a person whose legal residence is not in the State. See Maine Revised Statutes Title 29-A Sec. 101
  • Operator: means an individual who drives or is in control of a vehicle or who is exercising control over or steering a towed vehicle. See Maine Revised Statutes Title 29-A Sec. 101
  • Original registration: means a registration other than a renewal of registration by the same owner. See Maine Revised Statutes Title 29-A Sec. 101
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Owner: means a person holding title to a vehicle or having exclusive right to the use of the vehicle for a period of 30 days or more. See Maine Revised Statutes Title 29-A Sec. 101
  • Parking control vehicle: means a 3-wheel vehicle of 25 horsepower or less that has a metal roof and is operated by a law enforcement officer or a parking control officer to control parking and traffic. See Maine Revised Statutes Title 29-A Sec. 101
  • Patient: means an animal or group of animals examined or treated by a veterinarian. See Maine Revised Statutes Title 32 Sec. 4853
  • Person: means an individual, corporation, firm, partnership, joint venture, association, fiduciary, trust, estate or any other legal or commercial entity. See Maine Revised Statutes Title 29-A Sec. 101
  • Person: means any individual, firm, partnership, association, joint venture, cooperative and corporation or any other group or combination acting in concert; and whether or not acting as a principal, trustee, fiduciary, receiver or as any other kind of legal or personal representative, or as the successor in interest, assignee, agent, factor, servant, employee, director, officer or any other representative of such person.   • Pickup truck: means a truck with a registered gross vehicle weight of 10,000 pounds or less. See Maine Revised Statutes Title 29-A Sec. 101
  • Plaintiff: The person who files the complaint in a civil lawsuit.

  • registered mail: when used in connection with any requirement for notice by mail shall mean either registered mail or certified mail. See Maine Revised Statutes Title 1 Sec. 72
  • Registered weight: means the gross vehicle weight specified on the vehicle's registration certificate. See Maine Revised Statutes Title 29-A Sec. 101
  • Registration: means the registration certificate, plates and renewal devices pertaining to the registration of a vehicle, including temporary registered gross weight increases. See Maine Revised Statutes Title 29-A Sec. 101
  • Relief veterinary service: means the practice of veterinary medicine in Maine on a temporary basis by a qualified veterinarian not licensed to practice in this State for the purpose of substituting for a Maine-licensed veterinarian at a specified location during the licensee's absence or period of incapacitation. See Maine Revised Statutes Title 32 Sec. 4853
  • Resident: means a person who has declared or established residency in this State or has been domiciled in this State for a period of at least 30 days, except for persons in compliance with section 109, subsection 1. See Maine Revised Statutes Title 29-A Sec. 101
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • School of veterinary medicine: means any veterinary college or division of a college or university that offers the degree of Doctor of Veterinary Medicine or its equivalent and that conforms to the standards required by the Maine State Board of Veterinary Medicine as provided in this chapter. See Maine Revised Statutes Title 32 Sec. 4853
  • Semitrailer: includes , but is not limited to, so-called pole dollies and pole dickeys and wheels commonly used as a support for the ends of logs or other long articles. See Maine Revised Statutes Title 29-A Sec. 101
  • Service of process: The service of writs or summonses to the appropriate party.
  • Solid tires: means tires of solid rubber or other material that do not depend on confined air for the support of the load. See Maine Revised Statutes Title 29-A Sec. 101
  • Special mobile equipment: includes , but is not limited to, road construction or maintenance machinery, ditch-digging apparatus, stone crushers, air compressors, power shovels, cranes, graders, rollers, trucks used only to plow snow and for other duties pertaining to winter maintenance, including sanding and salting, well drillers and wood-sawing equipment or similar types of equipment.   • Sport utility vehicle: means a motor vehicle constructed on a light truck chassis but designed primarily for the transportation of persons or any motor vehicle designated by the United States Department of Transportation as a sport utility vehicle. See Maine Revised Statutes Title 29-A Sec. 101
  • Supervisor: means a licensed veterinarian or, if the task being supervised warrants, a licensed veterinary technician. See Maine Revised Statutes Title 32 Sec. 4853
  • Tiny home: means a living space permanently constructed on a frame or chassis and designed for use as permanent living quarters that:

  • Tow dolly: means a device towed by a motor vehicle and designed and used exclusively to transport another motor vehicle and on which the front or rear wheels of the towed motor vehicle are mounted, while the other wheels of the towed motor vehicle remain in contact with the ground. See Maine Revised Statutes Title 29-A Sec. 101
  • Tractor: means a motor vehicle used primarily off the highway for farming, forestry or other similar types of activities. See Maine Revised Statutes Title 29-A Sec. 101
  • Traffic: means pedestrians, ridden or herded animals, vehicles, bicycles and other conveyances either singly or together using public way for travel. See Maine Revised Statutes Title 29-A Sec. 101
  • Trailer: means a vehicle without motive power, designed to carry persons or property and to be drawn by a motor vehicle, not operated on railroad tracks, and so constructed that no part of its weight rests upon the towing vehicle. See Maine Revised Statutes Title 29-A Sec. 101
  • Truck: means a motor vehicle designed and used primarily to carry property. See Maine Revised Statutes Title 29-A Sec. 101
  • Truck tractor: means a motor vehicle designed and used exclusively to draw other vehicles and not constructed to carry a load other than a part of the weight of the vehicle and the load drawn. See Maine Revised Statutes Title 29-A Sec. 101
  • Vehicle: means a device for conveyance of persons or property on a way. See Maine Revised Statutes Title 29-A Sec. 101
  • Veterinarian: means a person who has received a doctor's degree in veterinary medicine from a school of veterinary medicine. See Maine Revised Statutes Title 32 Sec. 4853
  • Veterinary assistant: means a person employed in a veterinary facility to assist a licensed veterinarian or a licensed veterinary technician, but who has neither had the formal training required for licensure nor passed the required examination for licensure as a veterinary technician. See Maine Revised Statutes Title 32 Sec. 4853
  • Veterinary medicine: includes veterinary surgery, obstetrics, dentistry and all other branches or specialties of veterinary medicine including all aspects of the "practice of veterinary medicine" under subsection 7. See Maine Revised Statutes Title 32 Sec. 4853
  • Way: means the entire width between boundary lines of a road, highway, parkway, street or bridge used for vehicular traffic, whether public or private. See Maine Revised Statutes Title 29-A Sec. 101
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
  • Year: means a calendar year, unless otherwise expressed. See Maine Revised Statutes Title 1 Sec. 72
