Terms Used In Maine Revised Statutes > Title 4 > Chapter 15 > Subchapter 1 - Reporters in the Supreme and Superior Courts

  • Agent: means any person who sells or distributes potatoes or rotation crops in commerce for or on behalf of producers or others and whose operations may include the planting, cultivating, harvesting, grading, packing and furnishing containers, supplies or other services. See Maine Revised Statutes Title 7 Sec. 1012
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Applicant: means any person applying for a license under this Article. See Maine Revised Statutes Title 7 Sec. 1012
  • Board: means the Maine Potato Board established in Title 36, section 4603. See Maine Revised Statutes Title 7 Sec. 970
  • Broker: means any person engaged in the business of negotiating sales of potatoes in commerce for or on behalf of the seller or the purchaser, respectively. See Maine Revised Statutes Title 7 Sec. 1012
  • Butt measure: means the lineal measure of the butt end of tree length wood, without subsequent conversion to volume by any means. See Maine Revised Statutes Title 10 Sec. 2361-A
  • Butt scale: means the volume measure of wood based solely on measurement of the butt end of individual trees and converted to volume by any means. See Maine Revised Statutes Title 10 Sec. 2361-A
  • Buyer: means any person other than a consumer who purchases or contracts to purchase potatoes or rotation crops. See Maine Revised Statutes Title 7 Sec. 1012
  • Commercial processor: means a person who maintains an official establishment under this chapter for the purpose of processing livestock, meat, meat food products, poultry or poultry products other than for the exclusive use in the household of the owner of the commodity by the owner and members of the owner's household and the owner's nonpaying guests and employees. See Maine Revised Statutes Title 22 Sec. 2511
  • Commercial slaughterhouse: means a person engaged in the business of slaughtering livestock or poultry other than as a custom slaughterhouse. See Maine Revised Statutes Title 22 Sec. 2511
  • Commissioner: means the Commissioner of Agriculture, Conservation and Forestry or the commissioner's designee. See Maine Revised Statutes Title 22 Sec. 2511
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Court reporter: A person who makes a word-for-word record of what is said in court and produces a transcript of the proceedings upon request.
  • Custom slaughterhouse: means a person who maintains a registered establishment under this chapter for the purposes of slaughtering livestock or poultry for another person's exclusive use by that person and members of that person's household and that person's nonpaying guests and employees, and who is not engaged in the business of buying or selling carcasses, parts of carcasses, meat or meat food products or any cattle, sheep, swine, goats, poultry or other designated animals useable as human food.   • Dealer: means any person engaged in the business of buying or selling potatoes or rotation crops in wholesale or jobbing quantities in commerce and includes:

  • Department: means the Department of Health and Human Services. See Maine Revised Statutes Title 22 Sec. 1-A
  • Dependent: A person dependent for support upon another.
  • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Fund: means the Potato Marketing Improvement Fund established in Title 10, section 1023?N. See Maine Revised Statutes Title 7 Sec. 970
  • Green wood: means trees or parts of trees that have been freshly felled. See Maine Revised Statutes Title 10 Sec. 2361-A
  • Hauler: means the person, company or other entity that owns the truck or trailer on which a load of wood is transported. See Maine Revised Statutes Title 10 Sec. 2361-A
  • Immediate container: means a consumer package or any other container in which livestock products or poultry products are packed. See Maine Revised Statutes Title 22 Sec. 2511
  • in writing: include printing and other modes of making legible words. See Maine Revised Statutes Title 1 Sec. 72
  • Inspector: means an employee or official of the State or an employee or official of the Federal Government or of any other governmental entity of this State, authorized by the commissioner to perform inspection functions under this chapter under an agreement between the commissioner and the governmental entity. See Maine Revised Statutes Title 22 Sec. 2511
  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • Label: means a display of written, printed or graphic matter upon a product or the immediate container, not including package liners, of a product. See Maine Revised Statutes Title 22 Sec. 2511
  • Labeling: means all labels and other written, printed or graphic matter:

  • Licensed federal-state potato inspector: means an authorized representative of the Federal-State Inspection Service. See Maine Revised Statutes Title 7 Sec. 1012
  • Licensee: means any person who holds an unrevoked and valid unsuspended license issued under this Article. See Maine Revised Statutes Title 7 Sec. 1012
  • Livestock: means cattle, sheep, swine, goats or other designated animals, whether live or dead. See Maine Revised Statutes Title 22 Sec. 2511
  • Locally owned grocery store: means a grocery store at least 51% of which is owned by one or more residents of the State and that has a gross floor area of 25,000 square feet or less. See Maine Revised Statutes Title 22 Sec. 2511
  • Locally owned restaurant: means an eating establishment at least 51% of which is owned by one or more residents of the State and that is not a chain restaurant pursuant to section 2491, subsection 2?B. See Maine Revised Statutes Title 22 Sec. 2511
  • Meat: means muscle of livestock, an amenable species or an exotic animal as defined by the federal acts that is skeletal or that is found in the tongue, diaphragm, heart or esophagus, with or without the accompanying and overlying fat, and the portions of bone, skin, sinew, nerve and blood vessels that normally accompany the muscle tissue but does not include the muscle found in the lips, snout or ears.   • Mobile poultry processing unit: means a poultry slaughterhouse that meets the structural, operational and licensing requirements of a mobile poultry processing unit under the federal acts and that is operated by a person licensed under section 2514. See Maine Revised Statutes Title 22 Sec. 2511
  • Month: means a calendar month. See Maine Revised Statutes Title 1 Sec. 72
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: includes an individual, partnership, corporation, association or other business unit and an officer, agent or employee. See Maine Revised Statutes Title 22 Sec. 2511
  • Person: means both plural and the singular, as the case demands, and includes individuals, partnerships, corporations, companies, societies and associations;

  • Poultry: means a domesticated bird, whether live or dead. See Maine Revised Statutes Title 22 Sec. 2511
  • Poultry producer: means a person who raises poultry offered for sale. See Maine Revised Statutes Title 22 Sec. 2511
  • Poultry product: means a poultry carcass or part of a carcass or a product that is made wholly or in part from a poultry carcass or part of a carcass, excepting products that are exempted by the commissioner from definition as a poultry product under conditions that the commissioner may prescribe to ensure that the poultry ingredients in products are not adulterated and that these products are not represented as poultry products.   • Poultry Products Inspection Act: means the federal Act so entitled, approved August 28, 1957, 71 Stat. See Maine Revised Statutes Title 22 Sec. 2511
  • Prepared: means slaughtered, canned, salted, stuffed, rendered, boned, cut up or otherwise manufactured or processed. See Maine Revised Statutes Title 22 Sec. 2511
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Processor: means any person other than a consumer who purchases or contracts to purchase potatoes or rotation crops primarily for manufacture into articles of food or starch by operations that change the physical form the potatoes or rotation crops possessed when harvested. See Maine Revised Statutes Title 7 Sec. 1012
  • Properly prepared wood: means wood that was required to be harvested and yarded, and was prepared as directed, according to written cutting specifications. See Maine Revised Statutes Title 10 Sec. 2361-A
  • Rabbit producer: means a person that raises rabbits offered for sale. See Maine Revised Statutes Title 22 Sec. 2511
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Registered establishment: means a person registered under section 2514?A. See Maine Revised Statutes Title 22 Sec. 2511
  • Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
  • Retailer: means a person engaged in the business of buying potatoes or rotation crops in wholesale or jobbing quantities and reselling the potatoes or rotation crops bought primarily to consumers through at least 5 retail outlets located within or without the State. See Maine Revised Statutes Title 7 Sec. 1012
  • Rotation crop: means small grain, soybean or flax grown in rotation with potatoes. See Maine Revised Statutes Title 7 Sec. 1012
  • Sale: includes every contract of purchase or sale, contract to purchase or sell, purchase, sale and disposition of potatoes or rotation crops for value. See Maine Revised Statutes Title 7 Sec. 1012
  • Sale of wood: means a transaction involving transfer of title to wood. See Maine Revised Statutes Title 10 Sec. 2361-A
  • Seller: means any person who sells or contracts to sell potatoes or rotation crops in the regular course of business. See Maine Revised Statutes Title 7 Sec. 1012
  • Service of process: The service of writs or summonses to the appropriate party.
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Shipping container: means a container used or intended for use in packaging a livestock product or poultry product packed in an immediate container. See Maine Revised Statutes Title 22 Sec. 2511
  • Small enterprise: means a person licensed under section 2514 that processes 20,000 birds or fewer in a calendar year and that elects to operate under an exemption pursuant to section 2517?C, subsection 1?B. See Maine Revised Statutes Title 22 Sec. 2511
  • standard cord: means the cubic foot measurement of 4 foot long wood, ranked and well stowed, and stacked 4 feet wide, 4 feet high and 8 feet long, or its equivalent, which stack measure contains 128 cubic feet of wood, bark and air space. See Maine Revised Statutes Title 10 Sec. 2361-A
  • Statute: A law passed by a legislature.
  • Subpoena: A command to a witness to appear and give testimony.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Town: includes cities and plantations, unless otherwise expressed or implied. See Maine Revised Statutes Title 1 Sec. 72
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Trip ticket: means the form used to identify the origin and destination of a truckload of wood. See Maine Revised Statutes Title 10 Sec. 2361-A
  • United States: includes territories and the District of Columbia. See Maine Revised Statutes Title 1 Sec. 72
  • Verdict: The decision of a petit jury or a judge.
  • Verified complaint: means a writing signed by a person, who, under oath, swears that the person has reason to believe that a person required to be licensed under this Article has violated one or more of the provisions of this Article or of the rules and regulations promulgated thereunder, setting forth a short and plain statement of the allegations that are the basis for such belief.   • Wholesale or jobbing quantities: means aggregate quantities of potatoes totalling 25 tons, that is, 50,000 pounds, or more in weight purchased or contracted to be purchased in any calendar month. See Maine Revised Statutes Title 7 Sec. 1012
  • Wood: means the severed but unprocessed fibrous derivative of trees, without regard for quality or grade and also means the chipped fibrous derivative of trees. See Maine Revised Statutes Title 10 Sec. 2361-A
  • Wood transactions: means the "sale of wood" or "payment for services" as those terms are defined in this section. See Maine Revised Statutes Title 10 Sec. 2361-A
