  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Alcohol-related or other drug-related motor vehicle incident: means a conviction or administrative action resulting in the suspension of a motor vehicle operator's license for a violation under former Title 29, section 1311-A; Title 29, section 1312, subsection 10?A; Title 29, section 1312?C; Title 29, section 1312?B; Title 29, section 1313?B; Title 29, section 2241, subsection 1, paragraph N; Title 29, section 2241?G, subsection 2, paragraph B, subparagraph (2); Title 29, section 2241-J; Title 29?A, section 1253; Title 29?A, section 2411; Title 29?A, section 2453; Title 29?A, section 2454, subsection 2; Title 29?A, section 2456; Title 29?A, section 2457; Title 29?A, section 2472, subsection 3, paragraph B and subsection 4; Title 29?A, section 2503; Title 29?A, sections 2521 and 2523; or Title 29?A, section 2525 or the rules adopted by the Department of the Secretary of State for the suspension of commercial drivers' licenses.   • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Arborist: means a person who, for compensation, takes down or fells, diagnoses or evaluates the condition of shade or ornamental trees; solicits, recommends or supervises the treatment of those trees; or in any manner or for any purpose treats or cares for those trees. See Maine Revised Statutes Title 7 Sec. 2173
  • Butt measure: means the lineal measure of the butt end of tree length wood, without subsequent conversion to volume by any means. See Maine Revised Statutes Title 10 Sec. 2361-A
  • Butt scale: means the volume measure of wood based solely on measurement of the butt end of individual trees and converted to volume by any means. See Maine Revised Statutes Title 10 Sec. 2361-A
  • Client: means a person who is required to complete an alcohol and other drug education, evaluation and treatment program for an alcohol-related or drug-related motor vehicle offense. See Maine Revised Statutes Title 5 Sec. 20071
  • Commission: means the Substance Use Disorder Services Commission, as established by section 12004?G, subsection 13?C. See Maine Revised Statutes Title 5 Sec. 20003
  • Commissioner: means the Commissioner of Agriculture, Conservation and Forestry or the commissioner's designee. See Maine Revised Statutes Title 22 Sec. 2511
  • Community-based service provider: means a provider of either the treatment component or the evaluation component, or both, of the alcohol and other drug education, evaluation and treatment program certified under section 20075 or a program approved by the office. See Maine Revised Statutes Title 5 Sec. 20071
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Consumer pack: means a unit of 50 pounds or less net weight of potatoes contained in a bag or other type of container. See Maine Revised Statutes Title 7 Sec. 1032
  • Conviction: A judgement of guilt against a criminal defendant.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Department: means the Department of Health and Human Services. See Maine Revised Statutes Title 5 Sec. 20003
  • Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
  • deputy state sealer: shall mean , respectively, the State Sealer of Weights and Measures and the Deputy State Sealer of Weights and Measures;

  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Ex officio: Literally, by virtue of one's office.
  • First offender: means a client who has no previous alcohol-related or drug-related motor vehicle incident within a 10-year period. See Maine Revised Statutes Title 5 Sec. 20071
  • in writing: include printing and other modes of making legible words. See Maine Revised Statutes Title 1 Sec. 72
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Livestock: means cattle, sheep, swine, goats or other designated animals, whether live or dead. See Maine Revised Statutes Title 22 Sec. 2511
  • Maine bag: means any consumer pack for potatoes on which appears the word Maine in letters larger than 1/4 inch or a pictorial representation of the outline of the shape of the state. See Maine Revised Statutes Title 7 Sec. 1032
  • Maine bag grade: means any of the officially established grades of potatoes as adopted by the commissioner. See Maine Revised Statutes Title 7 Sec. 1032
  • Majority: when used in reference to age shall mean the age of 18 and over. See Maine Revised Statutes Title 1 Sec. 72
  • Meat: means muscle of livestock, an amenable species or an exotic animal as defined by the federal acts that is skeletal or that is found in the tongue, diaphragm, heart or esophagus, with or without the accompanying and overlying fat, and the portions of bone, skin, sinew, nerve and blood vessels that normally accompany the muscle tissue but does not include the muscle found in the lips, snout or ears.   • Multiple offender: means a client who has more than one alcohol-related or drug-related motor vehicle incident within a 10-year period or has a previous incident prior to the 10-year period for which the client has not completed a Driver Education and Evaluation Program as established in section 20072. See Maine Revised Statutes Title 5 Sec. 20071
  • Municipality: includes cities, towns and plantations, except that "municipality" does not include plantations in Title 10, chapter 110, subchapter IV; or Title 30?A, Part 2. See Maine Revised Statutes Title 1 Sec. 72
  • Official establishment: means an establishment as determined by the commissioner at which inspection of the slaughter of livestock or poultry or the preparation of livestock products or poultry products is maintained under the authority of this chapter. See Maine Revised Statutes Title 22 Sec. 2511
  • Ornamental trees: means trees of shade, beauty or landscape value, or those trees intended to become ornamental trees. See Maine Revised Statutes Title 7 Sec. 2173
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: includes an individual, partnership, corporation, association or other business unit and an officer, agent or employee. See Maine Revised Statutes Title 22 Sec. 2511
  • Person: means both plural and the singular, as the case demands, and includes individuals, partnerships, corporations, companies, societies and associations;
