Terms Used In Michigan Laws 333.27904

  • Department: means the department of licensing and regulatory affairs. See Michigan Laws 333.27902
  • Financial institution: means that term as defined in section 201 of the medical marihuana facilities licensing act, MCL 333. See Michigan Laws 333.27902
  • Freedom of Information Act: A federal law that mandates that all the records created and kept by federal agencies in the executive branch of government must be open for public inspection and copying. The only exceptions are those records that fall into one of nine exempted categories listed in the statute. Source: OCC
  • in writing: shall be construed to include printing, engraving, and lithographing; except that if the written signature of a person is required by law, the signature shall be the proper handwriting of the person or, if the person is unable to write, the person's proper mark, which may be, unless otherwise expressly prohibited by law, a clear and classifiable fingerprint of the person made with ink or another substance.   • Licensee: means that term as defined in section 102 of the medical marihuana facilities licensing act, MCL 333. See Michigan Laws 333.27902
  • Marihuana: means that term as defined in section 3 of the Michigan Regulation and Taxation of Marihuana Act, 2018 IL 1, MCL 333. See Michigan Laws 333.27902
  • Medical marihuana facilities licensing act: means the medical marihuana facilities licensing act, 2016 PA 281, MCL 333. See Michigan Laws 333.27902
  • system: means an internet-based, statewide database established, implemented, and maintained directly or indirectly by the department that is available to licensees, law enforcement agencies, and authorized state departments and agencies on a 24-hour basis for all of the following:
  (i) Verifying registry identification cards. See Michigan Laws 333.27902
  (1) The information in the system is confidential and is exempt from disclosure under the freedom of information act, 1976 PA 442, MCL 15.231 to 15.246. Information in the system may be disclosed pursuant to subsection (2) or for purposes of enforcing this act; the Michigan medical marihuana act, 2008 IL 1, MCL 333.26421 to 333.26430; and the medical marihuana facilities licensing act.
  (2) A licensee may, in writing, authorize the department to disclose the licensee’s information in the system described in section 3(2)(a) to (c) to a financial institution identified in the authorization. Upon receiving written authorization under this subsection, the department shall disclose the licensee’s information described in section 3(2)(a) to (c) to a financial institution identified in the authorization.
