- Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
- Air conditioning: means the process of treating air to meet the requirements of a conditioned space by controlling, either simultaneously or individually, the air's temperature, humidity, cleanness, and distribution. See Michigan Laws 339.5801
- Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- Armed forces: means the United States Army, Air Force, Navy, Marine Corps, Space Force, or Coast Guard or other military force designated by Congress as a part of the Armed Forces of the United States, including the reserve components. See Michigan Laws 339.5103
- Associated auxiliaries: means equipment that is required in the operation of a boiler that includes, but is not limited to, pumps, regulators, feedwater heaters, superheaters, de-superheaters, economizers, air preheaters, draft fans, combustion and pollution control equipment, and prime movers. See Michigan Laws 339.5901
- Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
- Board: means the electrical administrative board described in section 705. See Michigan Laws 339.5701
- Board: means the board of mechanical rules described in section 805. See Michigan Laws 339.5801
- Board: means the board of boiler rules described in section 905. See Michigan Laws 339.5901
- Boiler: means a closed vessel in which water is heated, steam is generated, or steam is superheated, or a combination of those actions occurs, under pressure or vacuum by the application of heat from combustible fuels, electricity, or nuclear energy. See Michigan Laws 339.5901
- certificate: means a certificate issued pursuant to sections 4, 5, and 6. See Michigan Laws 207.772
- Charitable organization: means a not-for-profit tax-exempt religious, educational, or humane organization. See Michigan Laws 339.5103
- Citation: means that term as described in section 537. See Michigan Laws 339.5103
- Commission: means the state tax commission created by 1927 PA 360, MCL 209. See Michigan Laws 207.772
- Condominium unit: means that portion of a structure intended for separate ownership, intended for residential use, and established under the condominium act, 1978 PA 59, MCL 559. See Michigan Laws 207.772
- Continuance: Putting off of a hearing ot trial until a later time.
- Contract: A legal written agreement that becomes binding when signed.
- Cooling: means air conditioning as defined in subdivision (a). See Michigan Laws 339.5801
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Department: means the department of licensing and regulatory affairs. See Michigan Laws 339.5103
- Developer: means a person who is the owner of a new facility at the time of construction or of a rehabilitated facility at the time of rehabilitation for which a neighborhood enterprise zone certificate is applied for or issued. See Michigan Laws 207.772
- Ductwork: means the air distribution arrangement for supply, return, and exhaust in air conditioning systems and in nonair conditioning systems, the materials and methods of which are specified in the Michigan mechanical code, or an equivalent nationally recognized model mechanical code. See Michigan Laws 339.5801
- Electrical contractor: means a person that is engaged in the business of erecting, installing, altering, repairing, servicing, or maintaining electrical wiring. See Michigan Laws 339.5701
- Electrical wiring: means all wiring, generating equipment, fixtures, appliances, devices, and appurtenances in connection with the generation, distribution, and utilization of electrical energy, in or on a building, residence, structure, or properties, regardless of whether or not the electrical wiring is energized at the time of installation. See Michigan Laws 339.5701
- Enforcing agency: means that term as defined in section 2a of the Stille-DeRossett-Hale single state construction code act, MCL 125. See Michigan Laws 339.5105
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- experience: includes any relevant experience acquired while serving in the armed forces by an individual who was separated from that service if all of the following are met:
(a) The applicant provides to the department a form DD214, a form DD215, or any other form that is satisfactory to the department that demonstrates that he or she was separated from that service, with an honorable character of service or under honorable conditions (general) character of service. See Michigan Laws 339.5903Facility: means a homestead facility, a new facility, or a rehabilitated facility. See Michigan Laws 207.772 Fire alarm system: means a system that is designed to detect and annunciate the presence of fire, or by-products of fire, installed in a building or structure. See Michigan Laws 339.5701 General public: means each individual who resides in this state and is 18 years of age or older, other than an individual or the spouse of an individual who is licensed or registered in the occupation or who has a material financial interest in the occupation that is regulated by the specific article in which the term is used. See Michigan Laws 339.5105 Good moral character: means that term as defined in, and determined under, 1974 PA 381, MCL 338. See Michigan Laws 339.5105 Governmental subdivision: means that term as defined in section 2a of the Stille-DeRossett-Hale single state construction code act, MCL 125. See Michigan Laws 339.5105 Homestead facility: means 1 of the following:
(i) An existing structure, purchased by or transferred to an owner after December 31, 1996, that has as its primary purpose residential housing consisting of 1 or 2 units, 1 of which is occupied by an owner as his or her principal residence and that is located within a subdivision platted pursuant to state law before January 1, 1968 other than an existing structure for which a certificate will or has been issued after December 31, 2006 in a city with a population of 750,000 or more, is located within a subdivision platted pursuant to state law before January 1, 1968. See Michigan Laws 207.772HVAC: means the application of equipment and systems to provide air conditioning for occupants of buildings and structures. See Michigan Laws 339.5801 in writing: shall be construed to include printing, engraving, and lithographing; except that if the written signature of a person is required by law, the signature shall be the proper handwriting of the person or, if the person is unable to write, the person's proper mark, which may be, unless otherwise expressly prohibited by law, a clear and classifiable fingerprint of the person made with ink or another substance. See Michigan Laws 8.3q Jobsite: means the immediate work area within the property lines of a single construction project, alteration project, or maintenance project where electrical construction or alteration of electrical wiring is in progress. See Michigan Laws 339.5703 Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases. Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC License: includes the whole or part of a governmental permit, certificate, approval, registration, charter, or similar form of permission required under a specific article of this act. See Michigan Laws 339.5105 Licensee: means a person that is issued a license under this act. See Michigan Laws 339.5105 Lien: A claim against real or personal property in satisfaction of a debt. Limited heating service: means the servicing of gas-designed sectional boilers that have inputs of not more than 1 million British thermal units, utilizing a combustion safeguard designed to shut off the main gas supply 10 or more seconds after pilot flame failure, and all other gas-fired or solid-fuel equipment and systems limited to input ratings of less than 400,000 British thermal units per unit; or oil-fired equipment and systems designed for the use of number 1 or number 2 fuel oil, that has a maximum firing rate of less than 5 gallons per hour per unit; or electrical furnaces and electric boilers that use the same kilowatts that are equivalent to the fossil fuel British thermal units generated. See Michigan Laws 339.5803 Local governmental unit: means a city, village, or township. See Michigan Laws 207.772 Michigan mechanical code: means part 9A of the state construction code, R 408. See Michigan Laws 339.5107 Michigan plumbing code: means part 7 of the state construction code, R 408. See Michigan Laws 339.5107 Minor repair work: means electrical wiring that has a value of $100. See Michigan Laws 339.5703 Municipality: means a city, village, or township. See Michigan Laws 339.5107 New facility: means 1 or both of the following:
(i) A new structure or a portion of a new structure that has as its primary purpose residential housing consisting of 1 or 2 units, 1 of which is or will be occupied by an owner as his or her principal residence. See Michigan Laws 207.772Owner: means the record title holder of, or the vendee of the original land contract pertaining to, a new facility, a homestead facility, or a rehabilitated facility for which a neighborhood enterprise zone certificate is applied for or issued. See Michigan Laws 207.772 person: may extend and be applied to bodies politic and corporate, as well as to individuals. See Michigan Laws 8.3l Person: means an individual, sole proprietorship, partnership, association, limited liability company, corporation, or common law trust or a combination of those legal entities. See Michigan Laws 339.5107 Process piping: means any piping which is not part of a system designed to provide air conditioning or of a refrigeration system. See Michigan Laws 339.5803 Qualified assessing authority: means 1 of the following:
(i) For a facility other than a homestead facility, the commission. See Michigan Laws 207.772Qualified downtown revitalization district: means an area located within 1 or more of the following:
(i) The boundaries of a downtown district as defined in section 201 of the recodified tax increment financing act, 2018 PA 57, MCL 125. See Michigan Laws 207.772Qualified historic building: means a property within a neighborhood enterprise zone that has been designated a historic resource as defined under section 266 of the income tax act of 1967, 1967 PA 281, MCL 206. See Michigan Laws 207.772 Quorum: The number of legislators that must be present to do business. Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land. Refrigeration: means the use of equipment and systems, including, but not limited to, refrigeration piping, employing the refrigeration cycle to generate low temperatures for other than air conditioning equipment and systems. See Michigan Laws 339.5803 Rehabilitated facility: means , except as otherwise provided in section 2a, an existing structure or a portion of an existing structure with a current true cash value of $120,000. See Michigan Laws 207.772 Related wiring: means any of the following:
(i) Except as otherwise provided in subparagraphs (i), (ii), (iii), and (iv), that portion of the electric sign wiring that originates at the load-side terminals of a disconnecting means located in the vicinity of the electric sign involved but does not include the installation of the disconnecting means, complete with line-side connections. See Michigan Laws 339.5703Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant. Servicing: means the maintenance, repair, and servicing of previously installed equipment and systems. See Michigan Laws 339.5803 Sign specialist: means an individual who, as his or her principal occupation, is engaged in the installation, alteration, or repair of electric signs. See Michigan Laws 339.5703 Sign specialty licensure: means licensure as a sign specialist or sign specialty contractor. See Michigan Laws 339.5703 state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories belonging to the United States; and the words "United States" shall be construed to include the district and territories. See Michigan Laws 8.3o State construction code: means the rules promulgated by the state construction code commission under section 4 of the Stille-DeRossett-Hale single state construction code act, MCL 125. See Michigan Laws 339.5107 stationary engineer: means an individual who is engaged in the operation of boilers and associated auxiliaries. See Michigan Laws 339.5901 United States: shall be construed to include the district and territories. See Michigan Laws 8.3o Unlimited heating service: means the servicing of heating equipment and systems without restrictions concerning thermal capacity or grade of fuel oil or type of fuel. See Michigan Laws 339.5803 Unlimited refrigeration and air conditioning service: means the servicing of refrigeration equipment and systems and air conditioning equipment and systems employing the refrigeration cycle unlimited as to thermal capacity or type of refrigerant.
