§ 32D.01 Definitions

Terms Used In Minnesota Statutes > Chapter 32D

  • abode: means domicile;

    (2) "action" means any proceeding in any court of this state;

    (3) "adult" means an individual 18 years of age or over;

    (4) "as now provided by law" means a reference to the laws in force at the time the law containing the phrase was finally enacted;

    (5) "as provided by law" means a reference to the laws in force at the particular time the law containing the phrase is applied;

    (6) "attorney at law" means an individual admitted to practice law by a court of record of this state;

    (7) "attorney of record" means an attorney at law who is entered on the docket or record of a court as appearing for or representing a party in a legal proceeding;

    (8) "child" or "children" includes children by birth or adoption;

    (9) "day" comprises the time from midnight to the next midnight;

    (10) "fiscal year" means the year by or for which accounts are reckoned;

    (11) "hereafter" means a reference to the time after the time when the law containing such word takes effect;

    (12) "heretofore" means a reference to the time previous to the time when the law containing such word takes effect;

    (13) "judicial sale" means a sale conducted by an officer or person authorized for the purpose by some competent tribunal;

    (14) "minor" means an individual under the age of 18 years;

    (15) "money" means lawful money of the United States;

    (16) "night time" means the time from sunset to sunrise;

    (17) "non compos mentis" refers to an individual of unsound mind;

    (18) "notary" means a notary public;

    (19) "now" in any provision of a law referring to other laws in force, or to persons in office, or to any facts or circumstances as existing, relates to the laws in force, or to the persons in office, or to the facts or circumstances existing, respectively, on the effective date of such provision;

    (20) "verified" when used in reference to writings, means supported by oath or affirmation. See Minnesota Statutes 645.45

  • Adulterated: means an item is covered by section 34A. See Minnesota Statutes 31.74
  • Appraisal assignment: means an engagement for which an appraiser is retained to act, as a disinterested third party in giving an unbiased analysis, opinion, or conclusion relating to the nature, quality, value, or utility of named interests in, or aspects of, identified real estate. See Minnesota Statutes 93.193
  • Appraisal management company: means a corporation, partnership, sole proprietorship, subsidiary, unit, or other business entity that directly or indirectly performs the following appraisal management services:

    (1) within a given 12-month period, as defined in section 82C. See Minnesota Statutes 93.193

  • Appraisal management services: means the process of directly or indirectly performing any of the following functions on behalf of a lender, financial institution, client, or any other person to:

    (1) administer an appraiser panel;

    (2) recruit, qualify, verify licensing or certification, and negotiate fees and service level expectations with persons who are part of an appraiser panel;

    (3) receive an order for an appraisal from one person, and deliver the order for the appraisal to an appraiser that is part of an appraiser panel for completion;

    (4) track and determine the status of orders for appraisals;

    (5) conduct quality control of a completed appraisal prior to the delivery of the appraisal to the person that ordered the appraisal; or

    (6) provide a completed appraisal performed by an appraiser to one or more clients. See Minnesota Statutes 93.193

  • Appraisal review: means the act of developing and communicating an opinion about the quality of another appraiser's work that was performed as part of an appraisal assignment, except that an examination of an appraisal for grammatical, typographical, or other similar errors that do not make a substantive valuation change shall not be an appraisal review. See Minnesota Statutes 93.193
  • Appraiser: means a person who is expected to perform valuation services competently and in a manner that is independent, impartial, and objective, and who is licensed under chapter 82B. See Minnesota Statutes 93.193
  • Appraiser panel: means a network of licensed or certified appraisers who are independent contractors to the appraisal management company that have:

    (1) responded to an invitation, request, or solicitation from an appraisal management company, in any form, to perform appraisals for persons that have ordered appraisals through the appraisal management company, or to perform appraisals for the appraisal management company directly, on a periodic basis, as requested and assigned by the appraisal management company; and

    (2) been selected and approved by an appraisal management company to perform appraisals for any client of the appraisal management company that has ordered an appraisal through the appraisal management company, or to perform appraisals for the appraisal management company directly, on a periodic basis, as assigned by the appraisal management company. See Minnesota Statutes 93.193

  • Bailee: means a person that by a warehouse receipt, bill of lading, or other document of title acknowledges possession of goods and contracts to deliver them. See Minnesota Statutes 336.7-102
  • Carrier: means a person that issues a bill of lading. See Minnesota Statutes 336.7-102
  • Chair: includes chairman, chairwoman, and chairperson. See Minnesota Statutes 645.44
  • Cheese: includes all varieties of cheese, cheese spreads, cheese foods, cheese compounds, or processed cheese made or manufactured in whole or in part from milk. See Minnesota Statutes 31.74
  • children: includes children by birth or adoption;

    (9) "day" comprises the time from midnight to the next midnight;

  • Client: means any person or entity that contracts with, or otherwise enters into an agreement with, an appraisal management company for the performance of real estate appraisal services or appraisal management services. See Minnesota Statutes 93.193
  • Commissioner: means the commissioner of agriculture. See Minnesota Statutes 31.74
  • Commissioner: means the commissioner of commerce. See Minnesota Statutes 93.193
  • Conservation easement: means a nonpossessory interest of a holder in real property imposing limitations or affirmative obligations the purposes of which include retaining or protecting natural, scenic, or open-space values of real property, assuring its availability for agricultural, forest, recreational, or open-space use, protecting natural resources, maintaining or enhancing air or water quality, or preserving the historical, architectural, archaeological, or cultural aspects of real property. See Minnesota Statutes 97A.451
  • Consignee: means a person named in a bill of lading to which or to whose order the bill promises delivery. See Minnesota Statutes 336.7-102
  • Consignor: means a person named in a bill of lading as the person from which the goods have been received for shipment. See Minnesota Statutes 336.7-102
  • Controlling person: means :

    (1) any owner, officer, or director of an appraisal management company seeking to offer appraisal management services in this state;

    (2) an individual employed, appointed, or authorized by an appraisal management company that has the authority to enter into a contractual relationship with other persons for the performance of appraisal management services and has the authority to enter into agreements with appraisers for the performance of appraisals;

    (3) an individual who possesses, directly or indirectly, the power to direct or cause the direction of the management or policies of an appraisal management company; or

    (4) an individual who enters into:

    (i) contractual relationships with clients for the performance of appraisal management services; and

    (ii) agreements with employed and independent appraisers for the performance of real estate appraisal services. See Minnesota Statutes 93.193

  • court administrator: means the court administrator of the court in which the action or proceeding is pending, and "court administrator's office" means that court administrator's office. See Minnesota Statutes 645.44
  • Dairy farm: means a place or premises where one or more lactating animals, including cows, goats, sheep, water buffalo, camels, or other hoofed mammals, are kept, and from which all or a portion of the milk produced at the place or premises is delivered, sold, or offered for sale. See Minnesota Statutes 31.74
  • Dairy plant: means any place where a dairy product is manufactured, processed, or handled and includes milk-receiving stations, creameries, cheese factories, condenseries, milk plants, transfer stations, and marketing organizations that purchase milk and cream directly from producers for resale and other establishments, as those terms are used in this chapter and chapters 17, 27, and 31; but does not include any place where dairy products are not processed but sold at wholesale or retail only. See Minnesota Statutes 31.74
  • Dairy product: means milk as defined by Code of Federal Regulations, title 21, cream, any product or by-product of either, or any commodity among the principal constituents or ingredients of which is one or a combination of two or more of them, as determined by standards, grades, or rules adopted by the commissioner. See Minnesota Statutes 31.74
  • Delivery order: means a record that contains an order to deliver goods directed to a warehouse, carrier, or other person that in the ordinary course of business issues warehouse receipts or bills of lading. See Minnesota Statutes 336.7-102
  • Designee: means any person designated by a responsible authority to be in charge of individual files or systems containing government data and to receive and comply with requests for government data. See Minnesota Statutes 336.3-302
  • domestic animals: include poultry. See Minnesota Statutes 31.875
  • Employee: means an individual who is treated as an employee for purposes of compliance with federal income tax laws. See Minnesota Statutes 93.193
  • estimated market value: has the meaning given in section 273. See Minnesota Statutes 645.44
  • Fluid milk products: means yogurt, cream, sour cream, half and half, reconstituted half and half, concentrated milk, concentrated milk products, skim milk, nonfat milk, chocolate flavored milk, chocolate flavored dairy drink, chocolate flavored reconstituted milk, chocolate flavored reconstituted dairy drink, buttermilk, cultured buttermilk, cultured milk, vitamin D milk, reconstituted or recombined milk, reconstituted cream, reconstituted skim milk, homogenized milk, and any other fluid milk product made by the addition of any substance to milk or to any of the fluid milk products enumerated under this subdivision or by rule adopted by the commissioner. See Minnesota Statutes 31.74
  • Goat milk: means a whole, fresh, clean lacteal secretion free from colostrum, obtained by the complete milking of one or more healthy goats. See Minnesota Statutes 31.74
  • Goods: means all things that are treated as movable for the purposes of a contract for storage or transportation. See Minnesota Statutes 336.7-102
  • Holder: means :

    (i) a governmental body empowered to hold an interest in real property under the laws of this state or the United States; or

    (ii) a charitable corporation, charitable association, or charitable trust, the purposes or powers of which include retaining or protecting the natural, scenic, or open-space values of real property, assuring the availability of real property for agricultural, forest, recreational, or open-space use, protecting natural resources, maintaining or enhancing air or water quality, or preserving the historical, architectural, archaeological, or cultural aspects of real property. See Minnesota Statutes 97A.451

  • Issuer: means a bailee that issues a document of title or, in the case of an unaccepted delivery order, the person that orders the possessor of goods to deliver. See Minnesota Statutes 336.7-102
  • Majority: means with respect to an individual the period of time after the individual reaches the age of 18. See Minnesota Statutes 645.451
  • Milk: means the normal lacteal secretion, practically free of colostrum, obtained by the milking of one or more healthy hoofed mammals. See Minnesota Statutes 31.74
  • Milk for manufacturing purposes: means milk produced for processing and manufacturing into products for human consumption but not subject to Grade A or comparable requirements. See Minnesota Statutes 31.74
  • Minnesota farmstead cheese: means cheese manufactured in Minnesota on the same farm that the milk used in its manufacturing is produced. See Minnesota Statutes 31.74
  • Oath: includes "affirmation" in all cases where by law an affirmation may be substituted for an oath; and in like cases "swear" includes "affirm" and "sworn" "affirmed. See Minnesota Statutes 645.44
  • Person: means a natural person, firm, partnership, limited liability partnership, corporation, association, limited liability company, or other form of business organization and the officers, directors, employees, or agents of that person. See Minnesota Statutes 93.193
  • Public member: means a person who is not, or never was, a member of the profession or occupation being licensed or regulated or the spouse of any such person, or a person who does not have or has never had, a material financial interest in either the providing of the professional service being licensed or regulated, or an activity directly related to the profession or occupation being licensed or regulated. See Minnesota Statutes 645.44
  • Public waters: means public waters as defined in section 103G. See Minnesota Statutes 645.44
  • rBGH: means a growth hormone intended for use in bovine animals that has been produced through recombinant DNA techniques, described alternately as recombinant bovine somatotropin or rBST. See Minnesota Statutes 31.74
  • seal: includes an impression thereof upon the paper alone, as well as an impression on a wafer, wax, or other substance thereto attached. See Minnesota Statutes 645.44
  • Third-party right of enforcement: means a right provided in a conservation easement to enforce any of its terms granted to a governmental body, charitable corporation, charitable association, or charitable trust, which, although eligible to be a holder, is not a holder. See Minnesota Statutes 97A.451
  • USPAP: means the Uniform Standards of Professional Appraisal Practice as established by the Appraisal Foundation. See Minnesota Statutes 93.193
  • Violate: includes failure to comply with. See Minnesota Statutes 645.44
  • Warehouse: means a person engaged in the business of storing goods for hire. See Minnesota Statutes 336.7-102
  • Wetlands: means lands transitional between terrestrial and aquatic systems where the water table is usually at or near the surface or the land is covered by shallow water. See Minnesota Statutes 645.44
