13-35-241. Release of vote tally — penalty. (1) A person may not make public the results of a vote tally from a precinct until after the polls close as provided in 13-1-106.

Terms Used In Montana Code 13-35-241

  • Knowingly: means only a knowledge that the facts exist which bring the act or omission within the provisions of this code. See Montana Code 1-1-204
  • Person: means an individual, corporation, association, firm, partnership, cooperative, committee, including a political committee, club, union, or other organization or group of individuals or a candidate as defined in subsection (8). See Montana Code 13-1-101
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Montana Code 1-1-201

(2)(a) A person who knowingly violates subsection (1) shall be imprisoned in the state prison for a term not to exceed 2 years or be fined an amount not less than $100,000 and not more than $500,000, or both.

(b)For the purposes of this section “knowingly” has the meaning specified in 45-2-101.
