75-15-215. Restrictions as to location. No license may be granted for the establishment, maintenance, or operation of a junkyard within 1,000 feet of the nearest edge of the right-of-way of a highway on the interstate or primary systems except a license may be granted for a junkyard:

Terms Used In Montana Code 75-15-215

  • Junkyard: means any establishment or place of business which is maintained, operated, or used for storing, keeping, buying, or selling junk, excluding a motor vehicle graveyard or motor vehicle wrecking facility which is regulated under Title 75, chapter 10, part 5, and excluding a garbage dump or sanitary landfill which is regulated under Title 75, chapter 10, part 2. (1)screened by natural objects, planted objects, fences, or other appropriate means so as not to be visible from the main-traveled way of any such highway or otherwise removed from sight;

(2)located within an area zoned for industrial use under authority of law;

(3)located within an unzoned industrial area, as determined from actual land uses and defined by rules promulgated by the department of transportation;

(4)that is not visible from the main-traveled way of any such highway.
