76-4-116. Annual and quarterly reports. (1) The department shall report annually to the environmental quality council in accordance with 5-11-210 summarizing the review procedures adopted under Title 76, chapter 4, and recommendations as to whether statutory changes should be made to the process.
Terms Used In Montana Code 76-4-116
- Department: means the department of environmental quality. See Montana Code 76-4-102
- Process: means a writ or summons issued in the course of judicial proceedings. See Montana Code 1-1-202
- Subdivision: means a division of land or land so divided that creates one or more parcels containing less than 20 acres, exclusive of public roadways, in order that the title to or possession of the parcels may be sold, rented, leased, or otherwise conveyed and includes any resubdivision, any condominium, townhome, or townhouse, or any parcel, regardless of size, that provides two or more permanent spaces for recreational camping vehicles or mobile homes. (2)The department shall report quarterly to the environmental quality council in accordance with 5-11-210 the number and percentage of overdue files as provided in 76-4-114(8).
(3)(a) Before July 1, 2028, the department shall provide a comprehensive review of subdivision review procedures, including an analysis of the role of independent reviewers, delays in permit issuance, and permit outcomes. The department shall consider and collect input from stakeholders in preparing the comprehensive review.
(b)The department shall report to the environmental quality council the information provided in the comprehensive review required in subsection (3)(a). The environmental quality council may provide recommendations to the department.
