No person other than a rescue squad member actually en route to, at, or returning from any emergency requiring the services of such member or any peace officer in the performance of his or her official duties shall operate a vessel equipped with a rotating or flashing red or blue light or lights upon the waters of this state.

Terms Used In Nebraska Statutes 37-1238.01

  • Operate: shall mean to navigate or otherwise use a motorboat or vessel. See Nebraska Statutes 37-1208
  • Peace officer: shall include sheriffs, coroners, jailers, marshals, police officers, state highway patrol officers, members of the National Guard on active service by direction of the Governor during periods of emergency, and all other persons with similar authority to make arrests. See Nebraska Statutes 49-801
  • Person: shall mean an individual, partnership, limited liability company, firm, corporation, association, or other entity. See Nebraska Statutes 37-1207
  • Vessel: shall mean every description of watercraft, other than a seaplane on the water, used or capable of being used as a means of transportation on water. See Nebraska Statutes 37-1203
  • Waters of this state: shall mean any waters within the territorial limits of Nebraska. See Nebraska Statutes 37-1206
