No gift or grant shall be deemed to have been made as an advancement unless:

- Decedent: A deceased person.
- Donee: The recipient of a gift.
- Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
1. So expressed in the gift or grant;
2. Charged in writing by the decedent as an advancement; or
3. Acknowledged in writing by the donee to be such.
