I. Any person seeking services from the state mental health services system may apply to an approved community mental health program or to a receiving facility.
II. Application shall be made by, or with the consent of, the person seeking services. An application for a person 18 years of age or older who has been adjudicated incapacitated in accordance with N.H. Rev. Stat. Chapter 464-A shall be made by, or with the consent of, his court appointed guardian. Application for a person under 18 years of age may be made by the person’s parent or legal guardian.

Terms Used In New Hampshire Revised Statutes 135-C:12

  • Community mental health program: means a program established and administered by the state, city, town, or county, or a nonprofit corporation for the purpose of providing mental health services to the residents of the area and which minimally provides emergency, medical or psychiatric screening and evaluation, case management, and psychotherapy services. See New Hampshire Revised Statutes 135-C:2
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • person: may extend and be applied to bodies corporate and politic as well as to individuals. See New Hampshire Revised Statutes 21:9
  • Receiving facility: means a treatment facility which is designated by the commissioner to accept for care, custody, and treatment persons involuntarily admitted to the state mental health services system. See New Hampshire Revised Statutes 135-C:2
  • state: when applied to different parts of the United States, may extend to and include the District of Columbia and the several territories, so called; and the words "United States" shall include said district and territories. See New Hampshire Revised Statutes 21:4

III. The program or facility shall determine the eligibility of the applicant, pursuant to N.H. Rev. Stat. § 135-C:13, to receive services from the state mental health services system and shall notify the applicant of the eligibility decision within 15 days after receipt of the application.
