I. Notwithstanding any provision of law to the contrary, the first instance a person has been charged with a violent crime and found incompetent to stand trial pursuant to N.H. Rev. Stat. § 135:17-a, and civilly committed pursuant to N.H. Rev. Stat. Chapter 135-C or RSA 171-B, found incompetent to stand trial pursuant to N.H. Rev. Stat. § 135:17 and committed pursuant to N.H. Rev. Stat. § 651:9-a, is transferred to another facility or discharged to the community, either conditionally or absolutely, the department of health and human services shall immediately notify the attorney general, who shall notify the victim as defined in N.H. Rev. Stat. § 21-M:8-k, I(a) and, in the event of a discharge, the law enforcement agency in the community to which the person is being discharged. For purposes of this section, discharge means the initial authorization by the administrative review committee of New Hampshire hospital to allow a person to leave the grounds of the hospital unaccompanied by a hospital staff member.
II. For purposes of this section, the term “violent crime” includes those crimes listed in N.H. Rev. Stat. § 651:5, XIII and the following:

  • following: when used by way of reference to any section of these laws, shall mean the section next preceding or following that in which such reference is made, unless some other is expressly designated. See New Hampshire Revised Statutes 21:13
  • person: may extend and be applied to bodies corporate and politic as well as to individuals. See New Hampshire Revised Statutes 21:9
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.

(b) N.H. Rev. Stat. § 631:2, second degree assault.
(c) N.H. Rev. Stat. § 631:3, felony reckless conduct.
(d) N.H. Rev. Stat. § 631:4, criminal threatening involving the use of a deadly weapon.
(e) N.H. Rev. Stat. § 633:3-a, stalking.
(f) N.H. Rev. Stat. § 635:1, burglary.
(g) N.H. Rev. Stat. § 641:5, tampering with witnesses and informants.
(h) N.H. Rev. Stat. § 650-A:1, felonious use of firearms.
