The following establishments and events shall be exempt from departmental licensure and inspection under this chapter, except that the department may inspect when the department has reason to suspect an imminent health hazard as defined in N.H. Rev. Stat. § 143-A:3, IV-b:
I. Food service establishments and retail food stores licensed by city health officers under N.H. Rev. Stat. § 47:17.

Terms Used In New Hampshire Revised Statutes 143-A:5

  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • farm: means any land, buildings, or structures on or in which agriculture and farming operations or activities are carried out or conducted and shall include the residence or residences of owners, occupants, or employees located on such land. See New Hampshire Revised Statutes 21:34-a
  • following: when used by way of reference to any section of these laws, shall mean the section next preceding or following that in which such reference is made, unless some other is expressly designated. See New Hampshire Revised Statutes 21:13
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • person: may extend and be applied to bodies corporate and politic as well as to individuals. See New Hampshire Revised Statutes 21:9
  • state: when applied to different parts of the United States, may extend to and include the District of Columbia and the several territories, so called; and the words "United States" shall include said district and territories. See New Hampshire Revised Statutes 21:4

II. Food service establishments and retail food stores licensed by town health officers under N.H. Rev. Stat. § 147:1.
III. Temporary food service establishments and occasional food service establishments and occasional food service events which are not under the jurisdiction of city or town health officers under N.H. Rev. Stat. § 147:1 and N.H. Rev. Stat. § 47:17.
IV. Recreation camps inspected and licensed under RSA 170-E, including recreation camps that offer food to camp families or alumni in the 45 days prior to or after the camp operating season.
V. Health care facilities inspected and licensed under RSA 151.
VI. Child care facilities inspected and licensed under RSA 170-E.
VII. Homestead food operations selling food, excluding potentially hazardous food as defined in N.H. Rev. Stat. § 143-A:12, I(b), from the homestead residence, at the owner’s farm stand, or at farmers’ markets.
VIII. A farm owned or operated by a federally exempt poultry producer, as defined in N.H. Rev. Stat. § 143-A:14, I, and the direct sale of such poultry to the consumer from the producer’s farm, at the producer’s farm stand, and by the producer at a farmers market, or when sold to a licensed restaurant in accordance with N.H. Rev. Stat. § 143-A:14 through N.H. Rev. Stat. § 143-A:17.
IX. A farm owned or operated by any person, firm, or corporation that raises bison, elk, or red deer for human consumption, and the direct sale within this state of the carcasses, parts, meat, and meat food products of such animals, when slaughtered and processed in accordance with N.H. Rev. Stat. § 427:2-a, IV, to the consumer from such farm, at the producer’s farm stand, and by the producer at farmers’ markets, or when sold to a licensed restaurant in accordance with N.H. Rev. Stat. § 143-A:20.
