Terms Used In New Hampshire Revised Statutes 460:7

  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • petition: when used in connection with the equity jurisdiction of the superior court, and referring to a document filed with the court, shall mean complaint, and "petitioner" shall mean plaintiff. See New Hampshire Revised Statutes 21:51
  • petitioner: shall mean plaintiff. See New Hampshire Revised Statutes 21:51
  • real estate: shall include lands, tenements, and hereditaments, and all rights thereto and interests therein. See New Hampshire Revised Statutes 21:21
Upon the filing of the petition, a citation to the friends of the insane wife or husband and to all interested shall issue and be published. A guardian shall be appointed to represent the insane wife or husband. If, after hearing, the judge is satisfied that the interests of all concerned would be promoted by the conveyance of the whole or any part of the petitioner‘s real estate, he may grant the license. A conveyance made under the license shall be a complete bar to all rights of the insane wife or husband in the premises so conveyed.
