Terms Used In New Hampshire Revised Statutes 528:8

  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Personal property: All property that is not real property.
Personal property subject to mortgage, pledge, security interest or lien may be taken on execution in the same manner that it may be attached, and may be sold in the same manner as other personal property; and the creditor and officer shall have the same right to demand an account of the amount due, and to hold the property, if no account or a false account is given, as in case of an attachment.
