Terms Used In New Hampshire Revised Statutes 597:4

  • Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • justice: when applied to a magistrate, shall mean a justice of a municipal court, or a justice of the peace having jurisdiction over the subject-matter. See New Hampshire Revised Statutes 21:12
  • person: may extend and be applied to bodies corporate and politic as well as to individuals. See New Hampshire Revised Statutes 21:9
If any person is charged with murder, the superior court or any justice thereof, upon application and notice to the attorney general or county attorney, and examination of such evidence as may be laid before them, may determine the amount of the bail, and take the recognizance required or authorize the clerk or any suitable justice to take it.
