Terms Used In New Hampshire Revised Statutes 601:6

  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • state: when applied to different parts of the United States, may extend to and include the District of Columbia and the several territories, so called; and the words "United States" shall include said district and territories. See New Hampshire Revised Statutes 21:4
In indictments charging any degree of murder, including capital murder, it is not necessary to set forth the manner in which or the means by which the death of the deceased was caused, but it is sufficient in an indictment for murder to charge the culpable mental state applicable and, where appropriate, the particular circumstances set forth in N.H. Rev. Stat. § 630:1, I, N.H. Rev. Stat. § 630:1-a, I, or N.H. Rev. Stat. § 630:1-b, I, constituting an element of the offense charged, and in an indictment for manslaughter to charge the culpable mental state applicable and, where appropriate, the particular circumstances set forth in N.H. Rev. Stat. § 630:2 constituting an element of the offense charged.
