Terms Used In New Hampshire Revised Statutes 614:2

  • Arrest: Taking physical custody of a person by lawful authority.
  • Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
  • Extradition: The formal process of delivering an accused or convicted person from authorities in one state to authorities in another state.
  • justice: when applied to a magistrate, shall mean a justice of a municipal court, or a justice of the peace having jurisdiction over the subject-matter. See New Hampshire Revised Statutes 21:12
  • person: may extend and be applied to bodies corporate and politic as well as to individuals. See New Hampshire Revised Statutes 21:9
  • state: when applied to different parts of the United States, may extend to and include the District of Columbia and the several territories, so called; and the words "United States" shall include said district and territories. See New Hampshire Revised Statutes 21:4
If an arrest is made in this state by an officer of another state in accordance with the provisions of N.H. Rev. Stat. § 614:1, he shall without unnecessary delay take the person arrested before any justice of the superior court or of the district court or the municipal court of any city who shall conduct a hearing for the purpose of determining the lawfulness of the arrest. If said justice determines that the arrest was lawful, he shall commit the person arrested to await for a reasonable time the issuance of an extradition warrant by the governor of this state, or admit such person to bail pending the issuance of such warrant. If the said justice determines that the arrest was unlawful, he shall discharge the person arrested.
