Terms Used In New Jersey Statutes 24:6L-7

  • Device: means instruments, apparatus, and contrivances, including their components, parts, and accessories, intended (1) for use in the diagnosis, cure, mitigation, treatment, or prevention of disease in man or other animals. See New Jersey Statutes 24:1-1
  • person: includes corporations, companies, associations, societies, firms, partnerships and joint stock companies as well as individuals, unless restricted by the context to an individual as distinguished from a corporate entity or specifically restricted to one or some of the above enumerated synonyms and, when used to designate the owner of property which may be the subject of an offense, includes this State, the United States, any other State of the United States as defined infra and any foreign country or government lawfully owning or possessing property within this State. 7. Nothing in this act shall be construed to:

a. permit a person who has completed a training program pursuant to this act to perform the duties or fill the position of a licensed medical professional;

b. prohibit the administration of an epinephrine auto-injector device by a person acting pursuant to a lawful prescription;

c. prevent a licensed and qualified member of a health care profession from administering an epinephrine auto-injector device if the duties are consistent with the accepted standards of practice applicable to the member’s profession; or

d. violate the “Athletic Training Licensure Act,” P.L.1984, c.203 (C. 45:9-37.35 et seq.) in the event that a licensed athletic trainer administers epinephrine as authorized pursuant to this act.
