§ 97-jjjj. Education assessment account. 1. There is hereby established in the joint custody of the state comptroller and the commissioner of taxation and finance an account of the miscellaneous special revenue fund to be known as the "education assessment account".

Notwithstanding any other law, rule or regulation to the contrary, the state comptroller is hereby authorized and directed to receive for deposit to the credit of the education assessment account all revenues received pursuant to an appropriation for such account, including but not limited to funds transferred from another account.

3. Moneys of this account, following appropriation by the legislature, shall be available to the state education department for services and expenses relating to state assessments of elementary and secondary school students, including but not limited to the state high school equivalency diploma examination. Moneys of this account shall only be available for expenditure pursuant to approval of an expenditure plan by the director of the budget.
