(a)        Cities. – All of the powers granted by this Chapter may be exercised by any city within its corporate limits and within any extraterritorial area established pursuant to N.C. Gen. Stat. § 160D-202

(b)        Counties. – All of the powers granted by this Chapter may be exercised by any county throughout the county except in areas subject to municipal planning and development regulation jurisdiction.

(c)        Partial Jurisdiction Regulation in Cities and Counties. – If a city elects to adopt zoning or subdivision regulations, each must be applied to the city’s entire planning and development regulation jurisdiction. If a county elects to adopt zoning or subdivision regulations, each may be applied to all or part of the county’s planning and development regulation jurisdiction. A local government‘s planning and development regulation jurisdiction does not include an area in which it has ceded jurisdiction pursuant to an agreement under N.C. Gen. Stat. § 160D-203 ?(2019-111, s. 2.4; 2020-3, s. 4.33(a); 2020-25, ss. 7, 51(a), (b), (d).)

  • City: As defined in N. See North Carolina General Statutes 160D-102
  • Development: Any of the following:

    a. See North Carolina General Statutes 160D-102

  • Development regulation: A unified development ordinance, zoning regulation, subdivision regulation, erosion and sedimentation control regulation, floodplain or flood damage prevention regulation, mountain ridge protection regulation, stormwater control regulation, wireless telecommunication facility regulation, historic preservation or landmark regulation, housing code, State Building Code enforcement, or any other regulation adopted pursuant to this Chapter, or a local act or charter that regulates land use or development.   • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Local government: A city or county. See North Carolina General Statutes 160D-102
  • Planning and development regulation jurisdiction: The geographic area defined in Part 2 of this Chapter within which a city or county may undertake planning and apply the development regulations authorized by this Chapter. See North Carolina General Statutes 160D-102
  • Subdivision: The division of land for the purpose of sale or development as specified in N. See North Carolina General Statutes 160D-102
