Terms Used In North Carolina General Statutes 7B-3502

  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Summons: Another word for subpoena used by the criminal justice system.

A copy of the filed petition along with a summons shall be served upon the petitioner’s parent, guardian, or custodian who shall be named as respondents. The summons shall include the time and place of the hearing and shall notify the respondents to file written answer within 30 days after service of the summons and petition. In the event that personal service cannot be obtained, service shall be in accordance with N.C. Gen. Stat. § 1A-1, Rule 4(j). (1979, c. 815, s. 1; 1998-202, s. 6.)
