Terms Used In North Carolina General Statutes > Chapter 1 > Article 44B

  • Architect: means a person who is duly licensed to practice architecture. See North Carolina General Statutes 19A-40
  • Attorney General: means the Attorney General of North Carolina or any employee of the Department of Justice designated by him in writing. See North Carolina General Statutes 19A-20
  • Beneficial interest: means either of the following:

  • bid: means a written or oral offer or proposal by an exhibitor to a distributor, in response to an invitation to bid for the right to exhibit a motion picture, stating the terms under which the exhibitor will agree to exhibit a motion picture. See North Carolina General Statutes 19A-4
  • blind bidding: means the bidding for, negotiating for, or offering or agreeing to terms for the licensing or exhibition of, a motion picture if such first run motion picture has not been trade screened within the State before? any such event has occurred. See North Carolina General Statutes 19A-4
  • Board: means the North Carolina Board of Architecture. See North Carolina General Statutes 19A-40
  • Civil proceeding: means any civil proceeding commenced by the Attorney General or an injured person under any provision of this Chapter. See North Carolina General Statutes 19A-20
  • Corporate certificate: means a certificate of corporate registration issued by the Board recognizing the corporation? named in the certificate as meeting the requirements for the corporate practice of architecture. See North Carolina General Statutes 19A-40
  • Criminal proceeding: means any criminal action commenced by the State for a violation of any provision of those criminal laws referred to in G. See North Carolina General Statutes 19A-20
  • distributor: means any person engaged in the business of distributing or supplying motion pictures to exhibitors by rental or licensing. See North Carolina General Statutes 19A-4
  • Documentary material: means any book, paper, document, writing, drawing, graph, chart, photograph, phonocord, magnetic tape, computer printout, other data compilation from which information can be obtained or from which information can be translated into useable form, or other tangible item. See North Carolina General Statutes 19A-20
  • Enterprise: means any person, sole proprietorship, partnership, corporation, business trust, union chartered under the laws of this State, or other legal entity; or any unchartered union, association, or group of individuals associated in fact although not a legal entity; and it includes illicit as well as licit enterprises and governmental as well as other entities. See North Carolina General Statutes 19A-20
  • exhibition: means showing a motion picture to the public for a charge. See North Carolina General Statutes 19A-4
  • exhibitor: means any person engaged in the business of operating one or more theatres. See North Carolina General Statutes 19A-4
  • following: when used by way of reference to any section of a statute, shall be construed to mean the section next preceding or next following that in which such reference is made; unless when some other section is expressly designated in such reference. See North Carolina General Statutes 15A-941
  • Good moral character: means such character as tends to assure the faithful discharge of the fiduciary duties of an? architect to his client. See North Carolina General Statutes 19A-40
  • in writing: may be construed to include printing, engraving, lithographing, and any other mode of representing words and letters: Provided, that in all cases where a written signature is required by law, the same shall be in a proper handwriting, or in a proper mark. See North Carolina General Statutes 15A-941
  • invitation to bid: means a written or oral solicitation or invitation by a distributor to one or more exhibitors to bid or negotiate for the right to exhibit a first run motion picture. See North Carolina General Statutes 19A-4
  • License: means a certificate of registration issued by the Board recognizing the individual named in the certificate as meeting the requirements for registration under this Chapter. See North Carolina General Statutes 19A-40
  • license agreement: means any contract, agreement, understanding or condition between a distributor and an exhibitor relating to the licensing or exhibition of a motion picture by the exhibitor. See North Carolina General Statutes 19A-4
  • month: shall be construed to mean a calendar month, unless otherwise expressed; and the word "year" a calendar year, unless otherwise expressed; and the word "year" alone shall be equivalent to the expression "year of our Lord. See North Carolina General Statutes 15A-941
  • oath: shall be construed to include "affirmation" in all cases where by law an affirmation may be substituted for an oath, and in like cases the word "sworn" shall be construed to include the word "affirmed. See North Carolina General Statutes 15A-941
  • Pattern of racketeering activity: means engaging in at least two incidents of racketeering activity that have the same or similar purposes, results, accomplices, victims, or methods of commission or otherwise are interrelated by distinguishing characteristics and are not isolated and unrelated incidents, provided at least one of such incidents occurred after October 1, 1986, and that at least one other of such incidents occurred within a four-year period of time of the other, excluding any periods of imprisonment, after the commission of a prior incident of racketeering activity.   • person: includes one or more individuals, partnerships, associations, societies, trusts, or corporations. See North Carolina General Statutes 19A-4
  • Person: includes "entity" (as that term is defined in G. See North Carolina General Statutes 19A-32
  • personal property: shall include moneys, goods, chattels, choses in action and evidences of debt, including all things capable of ownership, not descendable to heirs at law. See North Carolina General Statutes 15A-941
  • Practice of architecture: means performing or offering to perform or holding oneself out as legally qualified to perform professional services in connection with the design, construction, enlargement or alteration of buildings, including consultations, investigations, evaluations, preliminary studies, the preparation of plans, specifications and contract documents, administration of construction contracts and related services or combination of services in connection with the design and construction of buildings, regardless of whether these services are performed in person or as the directing head of an office or organization. See North Carolina General Statutes 19A-40
  • property: shall include all property, both real and personal. See North Carolina General Statutes 15A-941
  • Racketeering activity: means to commit, to attempt to commit, or to solicit, coerce, or intimidate another person to commit an act or acts which would be chargeable by indictment if such act or acts were accompanied by the necessary mens rea or criminal intent under the following laws of this State:

  • Real property: means any real property situated in this State or any interest in such real property, including, but not limited to, any lease of or mortgage upon such real property. See North Carolina General Statutes 19A-20
  • RICO lien notice: means the notice described in G. See North Carolina General Statutes 19A-20
  • run: means the continuous exhibition of a motion picture in a defined geographic area for a specified period of time. See North Carolina General Statutes 19A-4
  • seal: shall be construed to include an impression of such official seal, made upon the paper alone, as well as an impression made by means of a wafer or of wax affixed thereto. See North Carolina General Statutes 15A-941
  • state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories, so called; and the words "United States" shall be construed to include the said district and territories and all dependencies. See North Carolina General Statutes 15A-941
  • trade screening: means the showing of a motion picture by a distributor within the State which is open to any exhibitor interested in exhibiting the motion picture. See North Carolina General Statutes 19A-4
  • Trustee: means either of the following:

  • United States: shall be construed to include the said district and territories and all dependencies. See North Carolina General Statutes 15A-941
