Terms Used In North Carolina General Statutes > Chapter 7B > Article 40 - Interstate Compact for Juveniles

  • Accredited school of veterinary medicine: Any veterinary college or division of a university or college that offers the degree of doctor of veterinary medicine or its equivalent and that conforms to the standards required for accreditation by the American Veterinary Medical Association. See North Carolina General Statutes 90-181
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Animal: Any animal, mammal other than man and includes birds, fish, and reptiles, wild or domestic, living or dead. See North Carolina General Statutes 90-181
  • Animal dentistry: The treatment, extraction, cleaning, adjustment, or "floating" (filing or smoothing) of an animal's teeth, and treatment of an animal's gums. See North Carolina General Statutes 90-181
  • Board: The North Carolina Veterinary Medical Board. See North Carolina General Statutes 90-181
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • cruelty: include every act, omission, or neglect causing or permitting unjustifiable physical pain, suffering, or death. See North Carolina General Statutes 90-181
  • Cruelty to animals: To willfully overdrive, overload, wound, injure, torture, torment, deprive of necessary sustenance, cruelly beat, needlessly mutilate or kill any animal, or cause or procure any of these acts to be done to an animal. See North Carolina General Statutes 90-181
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Dependent: A person dependent for support upon another.
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Ex officio: Literally, by virtue of one's office.
  • Fiduciary: A trustee, executor, or administrator.
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • following: when used by way of reference to any section of a statute, shall be construed to mean the section next preceding or next following that in which such reference is made; unless when some other section is expressly designated in such reference. See North Carolina General Statutes 12-3
  • Fraud: Intentional deception resulting in injury to another.
  • Impairment: An individual's inability to practice veterinary medicine. See North Carolina General Statutes 90-181
  • in writing: may be construed to include printing, engraving, lithographing, and any other mode of representing words and letters: Provided, that in all cases where a written signature is required by law, the same shall be in a proper handwriting, or in a proper mark. See North Carolina General Statutes 12-3
  • Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
  • Interconceptional care: includes but is not limited to:

  • Staff: Any person performing duties under the direction and supervision of a veterinarian. See North Carolina General Statutes 90-181
  • state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories, so called; and the words "United States" shall be construed to include the said district and territories and all dependencies. See North Carolina General Statutes 12-3
  • Statute: A law passed by a legislature.
  • Subpoena: A command to a witness to appear and give testimony.
  • Trustee: A person or institution holding and administering property in trust.
  • United States: shall be construed to include the said district and territories and all dependencies. See North Carolina General Statutes 12-3
  • Veterinarian: A person who has received a doctor's degree in veterinary medicine from an accredited school of veterinary medicine and who is licensed by the Board to practice veterinary medicine. See North Carolina General Statutes 90-181
  • Veterinarian-client-patient relationship: Includes all of the following:

  • Veterinary consulting: When any person, whose expertise the veterinarian believes would benefit the veterinarian's patient, provides advice by any means of communication to a veterinarian at the veterinarian's direction or request. See North Carolina General Statutes 90-181
  • Veterinary license or license: A license to practice veterinary medicine issued by the Board. See North Carolina General Statutes 90-181
  • Veterinary medicine: Includes veterinary surgery, obstetrics, dentistry, and all other branches or specialties of veterinary medicine. See North Carolina General Statutes 90-181
  • Veterinary technician: Either of the following persons:
