Perishable property confiscated pursuant to this chapter may be sold without a court order by the officer making the seizure for the highest price obtainable. The proceeds of such sale must be deposited in a court of competent jurisdiction to await disposition by the court.

  • confiscated: means to hold subject to the order of a court of competent jurisdiction. See North Dakota Code 20.1-01-02
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.

  • sale: means any sale or offer to sell, or possession with intent to sell, use, or dispose of, the article or thing specified, contrary to law. See North Dakota Code 20.1-01-02
