The juvenile judge may enter into an agreement with the department of job and family services pursuant to section 5101.11 of the Revised Code for the purpose of reimbursing the court for foster care maintenance costs, associated administrative and training costs, and prevention services costs under the “Family First Prevention Services Act,” Public Law 115-123, incurred on behalf of a child who is any of the following:

Terms Used In Ohio Code 2151.152

  • Child: means a person who is under eighteen years of age, except that the juvenile court has jurisdiction over any person who is adjudicated an unruly child prior to attaining eighteen years of age until the person attains twenty-one years of age, and, for purposes of that jurisdiction related to that adjudication, a person who is so adjudicated an unruly child shall be deemed a "child" until the person attains twenty-one years of age.   • Juvenile judge: means a judge of a court having jurisdiction under this chapter. See Ohio Code 2151.011
  • Permanent custody: means a legal status that vests in a public children services agency or a private child placing agency, all parental rights, duties, and obligations, including the right to consent to adoption, and divests the natural parents or adoptive parents of all parental rights, privileges, and obligations, including all residual rights and obligations. See Ohio Code 2151.011
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.

(A) Eligible for payments under Title IV-E of the “Social Security Act,” 94 Stat. 501 (1980), 42 U.S.C.A. 670, and who is in the temporary or permanent custody of the court or subject to a disposition issued under division (A)(5) of section 2151.354 or division (A)(7)(a)(ii) or (A)(8) of section 2152.19 of the Revised Code;

(B) Determined to be at serious risk of removal from the home and for whom the court has undertaken a plan of reasonable efforts to prevent such removal;

(C) At imminent risk of removal from the home and is a sibling of a child in the temporary or permanent custody of the court.

The agreement shall govern the responsibilities and duties the court shall perform in providing services to the child.
