(A)(1) Notwithstanding section 3701.17 and any other section of the Revised Code pertaining to confidentiality, on the request of the domestic violence fatality review board, any individual, law enforcement agency, or other public or private entity that provided services to any of the following shall submit to the review board a summary sheet of information:

  • Child: includes child by adoption. See Ohio Code 1.59
  • Person: includes an individual, corporation, business trust, estate, trust, partnership, and association. See Ohio Code 1.59

(a) A person whose death is being reviewed by a domestic violence fatality review board;

(b) A person who caused the death of a person whose death is being reviewed by a domestic violence fatality review board;

(c) A child of a person whose death is being reviewed by a domestic violence fatality review board.

(2) With respect to a request made to a health care entity, the summary sheet shall contain only information available and reasonably drawn from the person’s or child’s medical record created by the health care entity.

(3) With respect to a request made to any other individual or entity, the summary sheet shall contain only information available and reasonably drawn from any record involving the person or child to which the individual or entity has access.

(4) On the request of the review board, an individual or entity may, at the individual or entity’s discretion, make any additional information, documents, or reports available to the review board.

(B) Notwithstanding division (A) of this section, no person, entity, law enforcement agency, or prosecuting attorney shall provide any information to a domestic violence fatality review board while an investigation of the death or prosecution of a person for causing the death is pending unless the prosecuting attorney has agreed pursuant to section 307.655 of the Revised Code to allow review of the death.
