The liquor control commission may determine and fix by rule the minimum percentage mark-up for sales at retail of beer, whether in case lot or less.

Terms Used In Ohio Code 4301.041

  • At retail: means for use or consumption by the purchaser and not for resale. See Ohio Code 4301.01
  • Beer: includes all beverages brewed or fermented wholly or in part from malt products and containing one-half of one per cent or more of alcohol by volume. See Ohio Code 4301.01
  • distributor: means a person engaged in the business of selling to retail dealers for purposes of resale. See Ohio Code 4301.01
  • liquor: include all liquids and compounds, other than beer, containing one-half of one per cent or more of alcohol by volume which are fit to use for beverage purposes, from whatever source and by whatever process produced, by whatever name called, and whether they are medicated, proprietary, or patented. See Ohio Code 4301.01
  • Manufacturer: means any person engaged in the business of manufacturing beer or intoxicating liquor. See Ohio Code 4301.01
  • Rule: includes regulation. See Ohio Code 1.59

To determine the retail price of beer, the minimum percentage mark-up may be applied to the wholesale price of the manufacturer or wholesale distributor charged to the retail permit holder. Such prices shall apply to sales made at retail by a permit holder for off-premise consumption only.
