(1) If any applicant for licensing or any person to whom a license has been issued fails to comply with the provisions of ORS § 446.310 to 446.350 or with the rules adopted pursuant thereto, the Oregon Health Authority may deny issuance of, suspend or revoke the license or assess a civil penalty.

(2) Hearings on the denial, suspension or revocation of a license or on assessing a civil penalty shall be conducted as a contested case in accordance with ORS Chapter 183. [1983 c.707 § 15; 2009 c.595 § 816]
