(1) Except as provided under ORS § 447.154 and subsection (3) of this section, no person shall offer to sell, sell or dispose of, by gift or otherwise, in connection with the person’s business an uncertified plumbing product.

Terms Used In Oregon Statutes 447.156

  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Person: includes individuals, corporations, associations, firms, partnerships, limited liability companies and joint stock companies. See Oregon Statutes 174.100

(2) The provisions of ORS § 447.152, 447.154 and 447.156 do not apply to products determined by rule not to be plumbing products.

(3) In addition to any other remedy provided by law, any person who purchases a plumbing product sold or disposed of in violation of ORS § 447.152 may recover from a person violating subsections (1) and (2) of this section an amount equal to the purchase price of the plumbing product if the purchaser returns the plumbing product within 90 days from the date of purchase.
