(1) A city that intends to continue to procure services from a contract building official shall, on or after January 1, 2022:

- City: includes any incorporated village or town. See Oregon Statutes 174.100
- Contract: A legal written agreement that becomes binding when signed.
- Department: means the Department of Consumer and Business Services. See Oregon Statutes 455.010
- Director: means the Director of the Department of Consumer and Business Services. See Oregon Statutes 455.010
(a) Comply with ORS § 455.202; and
(b) Submit an updated operating plan to the Director of the Department of Consumer and Business Services that outlines the city’s plan for compliance with ORS § 455.202.
(2) A city that does not comply with ORS § 455.202 or does not submit an updated operating plan as provided in subsection (1)(b) of this section may not procure services from a contract building official unless the city’s procurement occurs for the periods and under the circumstances described in ORS § 455.202 (2)(a)(A) and (B).
