(1) The Department of Environmental Quality may enter upon and inspect, at any reasonable time, any dry cleaning facility for the purpose of investigating either an actual or suspected violation of ORS § 466.930 or rules adopted under ORS § 466.930.

Terms Used In Oregon Statutes 466.935

  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one.   • Person: includes individuals, corporations, associations, firms, partnerships, limited liability companies and joint stock companies. See Oregon Statutes 174.100

(2) The department may require the owner or operator of any dry cleaning facility to furnish to the department information related to the use of perchloroethylene or n-propyl bromide as a dry cleaning solvent.

(3) The department may, at any reasonable time, inspect and copy a dry cleaning facility’s documents or records related to the use of perchloroethylene or n-propyl bromide as a dry cleaning solvent.

(4) Whenever it appears to the department that any person is engaged or about to engage in any acts or practices that constitute a violation of ORS § 466.930 or any rules or orders adopted or entered under ORS § 466.930, the department may, without prior administrative notice or hearing, institute actions or proceedings for legal or equitable remedies to enforce compliance with ORS § 466.930 or to restrain further violations of ORS § 466.930.
