(1) Justice courts and municipal courts acting as justice courts have concurrent jurisdiction with circuit courts of all prosecutions arising under ORS § 600.095 or a quarantine imposed under ORS § 600.105.

  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.

(2) In addition to any penalty provided by ORS § 600.990, the circuit court is vested with jurisdiction to restrain any violation, or threatened violation, of ORS § 600.095 or a quarantine imposed under ORS § 600.105 upon suit by the State Department of Agriculture. In any such suit the district attorney of the county where the suit is instituted shall represent the department, or the Attorney General may represent the department in the suit.
