(a)  Within the executive department there shall be a racing and athletics hearing board. The hearing board shall consist of three (3) members, not more than two (2) of whom shall be members of the same political party, who shall be appointed by the governor as provided in this section. In the month of February in each odd numbered year, the governor shall appoint one member of the board to hold office until the first day of March in the sixth year after his or her appointment and until his or her successor is appointed and qualified to succeed the member whose term will next expire.

  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.

(b)  Any vacancy which may occur in the board shall be filled by appointment by the governor for the remainder of the unexpired term. A member of the board may be removed by the governor only for cause, after being given a copy of charges against him or her and an opportunity to be heard publicly on the charges before the governor. A copy of the charges and a transcript of the record of the hearing shall be filed with the secretary of state.
